Notification of Clarification of the Standard Terms Determinations on Telecom’s Unbundled Copper Local Loop Network (‘UCLL’) and Telecom’s Sub-loop Unbundled Copper Local Loop Network Service (‘Sub-loop UCLL’)

The Commerce Commission (“Commission”) made standard terms determinations (STDs) under section 30M of the Telecommunications Act 2001 (“the Act”), in respect of the designated access service of “Telecom’s unbundled copper local loop network” set out in Part 2 of Schedule 1 of the Act:

  • Telecom’s UCLL Network Service (“Decision 609”) on 7 November 2007;
  • Telecom’s Sub-loop UCLL Network Service (“Sub-loop UCLL”) (“Decision 672”) on 18 June 2009.

Pursuant to section 58(2) of the Act, the Commission is required to give public notice that it has amended Decisions 609 and 672 for the purposes of making a clarification under section 58(1) of the Act.

Clarification Decision 697 made amendments to Decisions 609 and 672 to make it clear that the bulk rate for certain service components in the UCLL and Sub-loop UCLL Price Lists is applicable for 20 or more simultaneous new connections or transfers at the same exchange or distribution cabinet.

Notification of Clarification of the Standard Terms Determination on Telecom’s Unbundled Copper Local Loop Network Backhaul

The Commerce Commission (“Commission”) made a standard terms determination (STD) under section 30M of the Telecommunications Act 2001 (“the Act”), in respect of the designated access service of Telecom’s Unbundled Copper Local Loop Network Backhaul (“Decision 626”), on 27 June 2008.

Pursuant to section 58(2) of the Act, the Commission is required to give public notice that it has amended Decision 626 for the purposes of making a clarification under section 58(1) of the Act.

Clarification Decision 698 removes five exchanges from the table in Appendix C of Schedule 5 to the UCLL Backhaul General Terms, as the exchanges did not exist at the date of Decision 626.

Notification of Clarification of the Standard Terms Determination on Telecom’s Unbundled Bitstream Access Service

On 12 December 2007, the Commerce Commission (“Commission”) made a standard terms determination, under section 30M of the Telecommunications Act 2001 (“the Act”), in respect of the designated access service of Telecom’s Unbundled Bitstream Access (UBA) Service (“Decision 611”) which has been amended by way of clarification under section 58 of the Act on a number of occasions.

On 14 October 2010, Commission Decision 700 further amended Decision 611 under section 58 of the Act to clarify the pricing of UBA services in the situation where Access Seekers are purchasing Telecom’s commercially provided Sub-loop Extension Service (SLES) and Telecom’s Sub-loop Local Loop Network Service.

Pursuant to section 58(2) of the Act, the Commission is required to give public notice that it has amended Decision 611 for the purposes of making a clarification under section 58(1) of the Act.

Notice of Intention to Apply for Approval of Code of Practice—Extension of Submission Period

In Notice 7985 (published in the New Zealand Gazette, 14 October 2010, No. 140, page 3528), the Environmental Risk Management Authority gave notice that the Environmental Risk Management Agency intended to apply for approval of the Code of Practice for the Design and Installation of Below Ground Petroleum Stationary Container Systems, and the Code of Practice for the Operation of Below Ground Petroleum Stationary Container Systems.

The Environmental Risk Management Authority wishes to advise that the date for submissions is extended to 26 November 2010.
