Fisheries (Kaimoana Customary Fishing) Regulations 1998

Fisheries (Kaimoana Customary Fishing) Notice (No. 13) 2010 (No. F551)

Pursuant to Regulation 9 of the Fisheries (Kaimoana Customary Fishing) Regulations 1998, the Minister of Fisheries and Aquaculture gives the following notice.

Notice

1. Title and commencement—(1) This notice may be cited as the Fisheries (Kaimoana Customary Fishing) Notice (No. 13) 2010.

(2) This notice shall come into effect the day after the date of its notification in the New Zealand Gazette.

2. Interpretation—In this notice:

(a) “customary food-gathering” has the same meaning as defined in the Fisheries (Kaimoana Customary Fishing) Regulations 1998.

(b) “Tangata Kaitiaki/Tiaki” means the person or persons appointed under Regulation 9 of the Fisheries (Kaimoana Customary Fishing) Regulations 1998 for the management of customary food-gathering within the area/rohe moana.

(c) “area/rohe moana” means all that area of water enclosed by a line commencing at the mean high-water springs at Kakaraea (Karaka Point) (at 36°24.5’S and 174°21.1’E); then proceeding generally west to a point (at 36°23.9’S and 174°12.8’E); then proceeding generally south-west to a point (at 36°25.9’S and 174°06.6’E); then proceeding due west to the Exclusive Economic Zone to a point at latitude 36°25.9’S; then proceeding generally north along the Exclusive Economic Zone to a point at latitude 35°58.6’S; then proceeding due east to a point on the coastline north-west of Mahuta Gap (at 35°58.6’S and 173°45.5’E); then proceeding generally south-east along the mean high-water springs following the northern reaches of Kaipara Harbour to the point of commencement. The geographical coordinates named are in terms of the WGS84 datum.

3. Nomination of Tangata Kaitiaki/Tiaki—Te Uri o Hau has nominated Thomas De Thierry, Sandra Thompson, Ross Walker, Mihi Watene and William Wright as Tangata Kaitiaki/Tiaki for managing customary food-gathering within the area/rohe moana.

4. Confirmation of appointments—I confirm, under Regulation 9(1) of the Fisheries (Kaimoana Customary Fishing) Regulations 1998, the appointment of Thomas De Thierry, Sandra Thompson, Ross Walker, Mihi Watene and William Wright as Tangata Kaitiaki/Tiaki for managing customary food-gathering within the area/rohe moana.

5. Confirmation of tangata whenua—Te Uri o Hau is confirmed as the representative of tangata whenua of the area/rohe moana to which the appointment of Tangata Kaitiaki/Tiaki relates.

6. Power to authorise the taking of fisheries resources for customary food-gathering—A Tangata Kaitiaki/Tiaki appointed for the area/rohe moana may authorise any individual to take fisheries resources, managed under the Fisheries Act 1996, for customary food-gathering purposes from within the whole or any part of the area/rohe moana. No customary food-gathering of fisheries resources may take place in the area/rohe moana without an authorisation from a Tangata Kaitiaki/Tiaki.

7. Revocation—The Fisheries (Kaimoana Customary Fishing) Notice (No. 8) 2008 (No. F451), published in the New Zealand Gazette, 17 July 2008, No. 114, page 3022, is revoked.

Te Arawa Lakes (Fisheries) Regulations 2006

Te Arawa Lakes (Fisheries) Notice (No. 2) 2010 (No. F552)

Pursuant to Regulations 9 and 10 of Te Arawa Lakes (Fisheries) Regulations 2006, the Minister of Fisheries and Aquaculture gives the following notice.

Notice

1. Title and commencement—(1) This notice may be cited as Te Arawa Lakes (Fisheries) Notice (No. 2) 2010.

(2) This notice shall come into effect the day after the date of its notification in the New Zealand Gazette.

2. Interpretation—In this notice:

(a) “customary food-gathering” has the same meaning as defined in the Fisheries (Kaimoana Customary Fishing) Regulations 1998.

(b) “Poutiriao” and “Komiti Whakahaere” have the same meanings as defined in Te Arawa Lakes (Fisheries) Regulations 2006.

(c) “Poutiriao” means the person or persons appointed under Regulation 9 of Te Arawa Lakes (Fisheries) Regulations 2006 and who form the Komiti Whakahaere for the management of customary food-gathering within Te Arawa fisheries area.

(d) “Te Arawa fisheries area” is defined in Te Arawa Lakes Settlement Act 2006.

(e) “puka whakamana” has the same meaning as defined in Te Arawa Lakes (Fisheries) Regulations 2006.

3. Cancellation of appointments—Te Arawa Lakes Trust has notified me that Rea Rangiheuea-Martin and Tony Kapua have resigned as Poutiriao. Under Regulation 10(2) of Te Arawa Lakes (Fisheries) Regulations 2006 I hereby cancel the appointments of Rea Rangiheuea-Martin and Tony Kapua as Poutiriao.

4. Nomination of replacement Poutiriao—Te Arawa Lakes Trust has nominated John Ransfield and John Waaka as replacement Poutiriao to manage customary food-gathering within Te Arawa fisheries area.

5. Appointment of Poutiriao—I confirm, under Regulation 9(1) of Te Arawa Lakes (Fisheries) Regulations 2006, the appointment of John Ransfield and John Waaka as replacement Poutiriao to manage customary food-gathering within Te Arawa fisheries area from 23 June 2010. The three-year appointments will expire on 23 June 2013.
