Statement of Guarantee Given Under the Public Finance Act 1989

Pursuant to section 65ZD(3) of the Public Finance Act 1989, The Secretary to the Treasury makes the following statement:

“I, John Henry Whitehead, Secretary to the Treasury, on behalf of the Crown, under delegations from the Minister of Finance under section 28 of the State Sector Act 1988, gave a guarantee under the New Zealand Wholesale Funding Guarantee Scheme in respect of the following person on the following date:

Maritime Transport Act 1994

Maritime New Zealand (Functions and Duties) Notice 2009

Pursuant to section 431(2) of the Maritime Transport Act 1994 and section 112 of the Crown Entities Act 2004, the Minister of Transport gives the following notice.

Notice

1. Title—This notice is the Maritime New Zealand (Functions and Duties) Notice 2009.

2. Application—This notice applies to Maritime New Zealand (which is continued under section 429 of the Maritime Transport Act 1994).

3. Background—On 19 May 2006, the International Maritime Organization adopted Regulation 19-1 of Chapter V of the International Convention for the Safety of Life at Sea 1974, which concerns Long Range Identification and Tracking of ships (LRIT).

4. Additional functions and duties—Maritime New Zealand is directed to carry out the following additional functions and duties:

(a) To ensure New Zealand’s participation in the LRIT system by implementing New Zealand’s LRIT obligations, as follows:

(i) To provide a data centre for receiving LRIT information;

(ii) to provide appropriate reports to the International Maritime Organization; and

(iii) to bear all costs associated with receipt of, and requests for, LRIT information between Maritime New Zealand and other Contracting States;

(b) to undertake any duties that may be required for the purpose of performing the functions specified in paragraph (a).

Pursuant to Civil Aviation Rule Part 71.9(d), the following amendment was designated with effect from 2 July 2009—

• NZL 861 (Eyrewell low flying zone) is disestablished.
• New danger areas at Stratford (NZD 324) and Manaia (NZD 327) are established.

Pursuant to Civil Aviation Rule Part 71.9(d), the following amendment was designated with effect from 30 July 2009—

• NZL 860 (Eyrewell low flying zone) is established.

Pursuant to Civil Aviation Rule Part 71.9(d), the following amendment was designated with effect from 19 November 2009—

• NZD 120 (Otahuhu) is amended as NZD 120 Otara with boundary amendments and an additional Using Agency.
