4. Appointment of Tangata Tiaki/Kaitiaki

On 23 June 2009, the Minister of Fisheries appointed, under the Fisheries (South Island Customary Fishing) Regulations 1999, Hoani Sydney Langsbury as a Tangata Tiaki/Kaitiaki to manage customary food-gathering in the area/rohe moana. The appointment will expire on 15 April 2014.

5. Power to authorise taking of fisheries resources for customary food gathering

The Tangata Tiaki/Kaitiaki may authorise any individual to take fisheries resources managed under the Fisheries Act 1996 for customary food-gathering purposes from within the whole or any part of the area/rohe moana. No customary food-gathering of fisheries resources may take place in the area/rohe moana without an authorisation from a Tangata Tiaki/Kaitiaki.

Fisheries (South Island Customary Fishing) Notice (No. 7) 2009 (No. F488)

Pursuant to Regulation 9 of the Fisheries (South Island Customary Fishing) Regulations 1999, the Programme Manager (Deed of Settlement Implementation Programme) at the Ministry of Fisheries (acting pursuant to a delegated authority in accordance with section 41 of the State Sector Act 1988) gives the following notice.

Notice

  1. Title and commencement—(1) This notice may be cited as the Fisheries (South Island Customary Fishing) Notice (No. 7) 2009.

(2) This notice shall come into effect on 9 July 2009.

  1. Interpretation—In this notice:

(a) “customary food-gathering” has the same meaning as defined in the Fisheries (South Island Customary Fishing) Regulations 1999.

(b) “Tangata Tiaki/Kaitiaki” means the person or persons appointed under Regulation 9 of the Fisheries (South Island Customary Fishing) Regulations 1999 for the management of customary food-gathering within an area/rohe moana.

(c) “area/rohe moana” means the area from Piopiotahi to Tokatā. The area extends seaward to the limit of the “South Island fisheries waters” as defined in Regulation 2 of the Fisheries (South Island Customary Fishing) Regulations 1999, being the 200-mile limit, and inland to boundaries defined for Te Rūnanga o Awarua, Te Rūnanga o Oraka Aparima, Hokonui Rūnaka and Waihōpai Rūnaka in Te Rūnanga o Ngāi Tahu Act 1996. The area includes South Island waters about and within Rakiura (Stewart Island) and other offshore islands situated within the exclusive economic zone.

3. Nomination of Tangata Tiaki/Kaitiaki

The Hokonui Rūnaka, being the tangata whenua holding manawhenua manamoana over the area/rohe moana (as represented by Te Rūnanga o Ngāi Tahu), has nominated Rena Naina Peti Fowler and Rodney Ryan as Tangata Tiaki/Kaitiaki for the area/rohe moana for further terms.

4. Appointment of Tangata Tiaki/Kaitiaki

On 23 June 2009, the Minister of Fisheries confirmed, under Regulation 9(5) of the Fisheries (South Island Customary Fishing) Regulations 1999, the reappointment of Rena Naina Peti Fowler and Rodney Ryan as Tangata Tiaki/Kaitiaki for managing customary food-gathering in the area/rohe moana. The appointments will expire on 8 July 2014.

5. Power to authorise taking of fisheries resources for customary food gathering

A Tangata Tiaki/Kaitiaki may authorise any individual to take fisheries resources managed under the Fisheries Act 1996 for customary food-gathering purposes from within the whole or any part of the area/rohe moana for which they have been appointed as a Tangata Tiaki/Kaitiaki. No customary food-gathering of fisheries resources may take place in the area/rohe moana without an authorisation from a Tangata Tiaki/Kaitiaki.

Health and Disability Services (Safety) Act 2001

Designation of Auditing Agency

Pursuant to section 32 of the Health and Disability Services (Safety) Act 2001 (“the Act”), I, Anthony Hill, Deputy Director-General, Sector Accountability & Funding, Ministry of Health (“the Ministry”), under delegation from the Director-General of Health, designate Health Audit (NZ) Limited (the “Designated Auditing Agency” (DAA)) to audit the provision or likely future provision of the following kinds of health care services:

  • Hospital Care (as defined in section 4(1) of the Act);
  • Rest Home Care (as defined in section 6(2) of the Act); and
  • Residential Disability Care (as defined in section 4(1) of the Act).

This designation is subject to the following conditions:

  1. The DAA must comply with the requirements of the DAA Handbook issued by the Ministry and updated from time to time.

  2. Promptly after giving a certified provider or prospective provider an audit report, the DAA must:

    • complete the Ministry of Health Audit Report Tool and provide an electronic copy to the Ministry; and
    • provide a summary of the audit report to the Ministry (refer to condition 9).
  3. The DAA must provide any information about the auditing of health care services pursuant to the Act if requested in writing by the Ministry.

  4. During the term of the DAA’s designation, the DAA will allow the Ministry to audit or to commission the undertaking of audits or reviews of the DAA. This could also include attending audits being undertaken by the DAA.
