Civil Aviation Act 1990

Notification of Proposal to Make Ordinary Rules

In accordance with section 34(1)(a) of the Civil Aviation Act 1990, the Minister of Transport hereby gives notice of his intention to make the following ordinary Civil Aviation Rules:

CAR Part 61 Pilot Licences and Ratings

CAR Part 141 Aviation Training Organisations – Certification

The purpose of this Notice of Proposed Rule Making (NPRM) is to put forward for consultation amendments to Civil Aviation Rules (CARs) Part 61 Pilot Licences and Ratings and Part 141 Aviation Training Organisations – Certification, along with associated changes to Part 1 Definitions and Abbreviations, Part 12 Accidents, Incidents and Statistics and Part 145 Aircraft Maintenance Organisations – Certification.

The rule amendments in this NPRM propose that all aviation training and aviation assessment that is required by Part 61 for the issue, and currency requirements, of a pilot licence or rating be conducted under the authority of a certificate issued under the following CAR Parts:

  • Part 141 Aviation Training Organisations – Certification for all pilot training and aviation assessment required by Part 61
  • Part 119 Air Operator – Certification for Airline Transport Pilot Licence training
  • Part 137 Agricultural Aircraft Operations for agricultural training
  • Part 149 Aviation Recreational Organisations – Certification for parachute drop, glider tow, low level aerobatic ratings and other training as specified in Part 61.

New requirements for flight training organisations certificated under Part 141 are also proposed. These amendments are proposed in order to provide a more robust structure for, and increased regulatory oversight of, pilot training in New Zealand.

Telecommunications Act 2001

Notification of the Commerce Commission’s Final Determination for the Telecommunications Service Obligation Instrument for the Local Residential Telephone Service for the Period Between 1 July 2004 and 30 June 2005

On 10 September 2008, the Commerce Commission (“the Commission”) released its Final Determination for the Telecommunications Service Obligation (“TSO”) Instrument for Local Residential Service for the period between 1 July 2004 and 30 June 2005.

The Commission, acting pursuant to section 90(a) of the Telecommunications Act 2001 (“the Act”), made the final determination in respect of the matters set out in section 92 of the Act for the TSO instrument for the local residential telephone service.

Pursuant to section 90(b) of the Act, the Commission gives public notice of its final determination.

The transitional provisions for the TSO determinations that were enacted under the Telecommunications Amendment Act (No. 2) 2006 (“Amendment Act”) allowed the Commission to complete the 2004/05 final TSO Determination as if the Act had not been amended by the Amendment Act.

On 17 September 2008, the Commerce Commission (“the Commission”) released its Final Determination for the Telecommunications Service Obligation (“TSO”) Instrument for Local Residential Service for the period between 1 July 2005 and 30 June 2006.

The Commission, acting pursuant to section 90(a) of the Telecommunications Act 2001 (“the Act”), made the final determination in respect of the matters set out in section 92 of the Act for the TSO instrument for the local residential telephone service.
