Declaring Land to be Road and Service Lane and Land Acquired for Service Lane—Owen Street, Napier City

Pursuant to the Public Works Act 1981, and to a delegation from the Minister for Land Information, Stephen Alistair Gilbert, Land Information New Zealand:

(a) Pursuant to section 114(1), declares the land described in the First Schedule to this notice, to be road and vested in the Napier City Council;

(b) Also pursuant to section 114(1), declares the land described in the Second Schedule to this notice to be service lane and vested in the Napier City Council; and

(c) Pursuant to section 20(1), declares that, an agreement to that effect having been entered into, the land described in the Third Schedule to this notice, is hereby acquired for a service lane and shall be vested in the Napier City Council on the date of publication of this notice in the New Zealand Gazette.

In exercise of the powers conferred on it by delegated authority under the Reserves Act 1977, the Far North District Council notifies the following resolution passed by the council on 30 April 2009:

"That pursuant to Section 14 of the Act, the land described in the Schedule hereto is declared recreation reserve, subject to the provisions of the Act".
