Hazardous Substances (Group Standards) (Amendment) Notice 2009

Pursuant to section 96B of the Hazardous Substances and New Organisms Act 1996 (the Act) the Environmental Risk Management Authority, on its own initiative, gives the following notice.

1. Title

1.1 This notice is the Hazardous Substances (Group Standards) (Amendment) Notice 2009 and is part of the principal notice.

1.2 In this notice, "principal notice" means the Hazardous Substances (Group Standards) Notice 2009 (Supplement to the New Zealand Gazette, 30 June 2006, No. 74, at page 1889).

2. Commencement

This notice comes into force 28 days after the date of notification in the New Zealand Gazette.

3. Amendments to principal notice

3.1 Omit, in Part 27 of the principal notice, on page 2288 (Interpretation), the definition of "graphic material" and substitute the following definition:

graphic material means a material which is deposited onto another material by a graphics instrument including fingers and hands for the purpose of writing, drawing, painting or marking, and includes but is not limited to:

(a) a crayon;

(b) a water colour paint;

(c) a finger paint;

(d) pastels, chalk, coloured pencils and felt pens.

3.2 Insert, in Part 27 of the principal notice, on page 2288 (Interpretation), in the correct alphabetical order, the following definitions:

crayon means a stick of coloured waxy material for writing, drawing, marking or painting

water colour paint means a colouring material for imparting colours to an inanimate surface, made of pigment to be diluted with water and not oil. Water-colour paints do not include face paints

finger paint means a paste or jelly-like, coloured preparation specially designed for children, directly applicable to suitable surfaces with the fingers and hands

3.3 Omit, in the definition of "paint" in Part 27 of the principal notice, on page 2288 (Interpretation) of the principal notice, the words "and cosmetic products" and substitute the words ", cosmetic products, finger paints, children’s crayons and children’s water colour paints".

3.4 Amend, in Part 27 of the principal notice, the Group Standards listed in that Part in accordance with the notices set out in the Annex to this notice.
