Amendment to the Second Schedule to the Auckland Agricultural Pastoral and Industrial Shows Board Act 1972

Notice is hereby given that a mutual agreement dated the 26th day of March 2009, has been entered into between the Auckland Agricultural Pastoral and Industrial Shows Board, the Auckland Agricultural and Pastoral Association, and the Auckland Manufacturers Association Incorporated, in terms of section 9(1) of the Auckland Agricultural Pastoral and Industrial Shows Board Act 1972, and a copy of the said agreement has been filed with the head office of the Ministry of Agriculture and Forestry in Wellington.

Approval is given, in terms of section 9(3) of the Act, to the First Part of the Second Schedule to the Act being amended by adding a new clause 27 as follows:

“27 (1) Any income, benefit, or advantage must be used to advance the charitable purposes of the Board.

(2) No member of the Board, or anyone associated with a member, is allowed to take part in, or influence any decision made by the Board in respect of payments to, or on behalf of, the member or associated person of any income, benefit or advantage.

(3) Any payments made to a member of the Board, or person associated with a member, must be for goods or services that advance the charitable purpose and must be reasonable and relative to payments that would be made between unrelated parties.”

This notice shall come into operation on the day after the date of its publication in the New Zealand Gazette.

Notice of Appointment of Receiver of Income

Pursuant to Section 6 of the Receiverships Act 1993

Trustees Executors Limited (“the mortgagee”) is the mortgagee under memorandum of mortgage 7566229.2 (Otago Land Registry) dated the 18th day of September 2007 (“the mortgage”) given by ANDREW JAMES KIERNAN (“the mortgagor”) in favour of the mortgagee and affecting the land in certificate of title 324209 (Otago Land Registry), being the property known as Unit 39, 633 Frankton Road, Frankton, Queenstown (“the land”).

The mortgagor is in default under the mortgage and the mortgagee is entitled to appoint a receiver of the income from the land or any part of it, upon such default.

The mortgagee hereby appoints Libby Jack, of Queenstown Accommodation Centre, to be receiver of the income of the land with all the powers conferred upon a receiver in terms of the mortgage and by the law.

The receiver shall at all times be the agent of the mortgagor and not of the mortgagee.
