Fourth Schedule
Terms and Conditions of Leasehold Estate
Purpose for Which Leasehold Estate is Required
The leasehold estate is required over the land referred to in Schedule 2 of this notice (“the Land”), to allow the Crown to occupy it during the construction of the realignment of State Highway 7 (“the Project”):
(a) as a lay-down area for the parking of vehicles and machinery and storage of materials required for the Project; and
(b) if required, for the re-contouring of the Land and the driveway on the land as part of the Project.
Terms of the Leasehold Estate

The Crown must give the lessor three months notice in writing that it intends to enter the Land for occupation during the construction of the Project.

The leasehold estate shall have a term of two years, commencing on the date immediately following the expiry of the Crown’s notice, and terminating on the date two years thereafter.

Notwithstanding the term created, the Crown may terminate the leasehold estate at any time by giving the lessor one month’s notice in writing.

The Crown shall have the right to occupy the Land, including the right to enter and re-enter the Land at all times, with or without such vehicles, machinery or materials for the purpose set out in this notice.

The Crown shall take all reasonable steps to minimize disruption to the access to the balance of the Land held in Computer Freehold Register WS3A/907 during the Project.

The Crown shall repair any damage caused to any part of the surface of the Land (re-contouring accepted) resulting from the Crown’s occupation prior to expiry of the leasehold estate.

Notice of Intention to Take an Interest in Land for Motorway Purposes—Christchurch Southern Motorway, Christchurch, Canterbury Land District
Notice is hereby given that the Crown, under the provisions of section 23 of the Public Works Act 1981, proposes to take following parts of the easement interests specified in easement certificate A382130.5 appurtenant to the land in Computer Freehold Register CB45B/852 that are located on the land described in the Schedule to this notice:
(a) The right of way over the areas marked “B” and “C” on DP 78991;
(b) The right to drain sewage over the areas marked “C”, “D”, “E” and “F” on DP 78991;
(c) The right to convey electric power and telephonic communications over the areas marked “C”, “D”, “E” and “F” on DP 78991; and
(d) The right to convey water over the areas marked “C”, “D”, “E” and “F” on DP 78991.
The land described in the Schedule and the easement interest described above is required for motorway purposes for the Christchurch Southern Motorway.
It is necessary to take the easement interest in the land described above so that it can be extinguished when the land is taken for motorway purposes. The Christchurch Southern Motorway is required to cater for increasing traffic volumes and to improve the safety and efficiency of the State highway and the local road network.
The owner of the land and those persons with a registered interest in it have been served with notice of the Crown’s intention to take their land and their right to object.
Any other person having the right to object may send a written objection to the Registrar, Environment Court, 89 Armagh Street, Christchurch. Postal Address: PO Box 2069, Christchurch 8140, within 20 working days after the date of publication of this notice.
