Declaration by Chief Electoral Officer That Damien Peter O’Connor is Elected a Member of Parliament

WHEREAS—

A. I have received a warrant from Her Excellency the Administrator of the Government, to supply a member of Parliament to fill a vacancy created by the resignation of Michael John Cullen, pursuant to section 55(1)(f) of the Electoral Act 1993;

B. Under section 137(2) of the Electoral Act 1993, I have determined that, of the unelected candidates on the party list of the New Zealand Labour Party, Damien Peter O’Connor stood highest in the order of preference on that list;

C. Under section 137(3) of that Act, I have asked the Secretary of the New Zealand Labour Party whether Damien Peter O’Connor remains a member of that party and I have been informed that he remains a member of that party;

D. Under section 137(4) of that Act, I have asked Damien Peter O’Connor whether he is willing to be a member of Parliament and he has indicated his willingness to be a member of Parliament.

THEREFORE, pursuant to section 137(4) of that Act, I, Robert Andrew Peden, Chief Electoral Officer, declare that

Damien Peter O’Connor

is elected as a member of Parliament by publication of this declaration as a Supplement to the New Zealand Gazette.
