Notice of Intention to Take the Lessee’s Interest in Land for Road—Christchurch Southern Motorway – Halswell Junction Road Upgrade

Notice is hereby given that the Crown, under the provisions of section 23 of the Public Works Act 1981, proposes to take the interest under lease 7526247.2 in that part of the leasehold estate described in the Schedule hereto (“the land”).

The land described in the Schedule to this notice is required for road, namely for the Christchurch Southern Motorway – Halswell Junction Road Upgrade.

The lessee of the land and those persons with a registered interest in the lease have been served with notice of the Crown’s intention to take the land and their right to object.

Any other person having the right to object may send a written objection to the Registrar, Environment Court, 89 Armagh Street (PO Box 2069), Christchurch, within 20 working days after the date of publication of this notice.

If any objection is made in accordance with this notice, a public hearing will be heard with the right of the objector to appear and be heard personally unless the objector otherwise requires, and each objector will be informed of the time and place of the hearing.

Notice of Intention to Take Land for Road—Clark Street, New Lynn, Waitakere City

Notice is hereby given, in accordance with section 23(1)(b) of the Public Works Act 1981, that the Waitakere City Council (“Council”) proposes to take part of the land situated at 5 Clark Street, New Lynn, Waitakere City, and more particularly described in the Schedule hereto (“the land”).

The land is required for roading purposes and it is intended to use the land for the redevelopment and widening of Clark Street, New Lynn, Waitakere City, to cater for future traffic requirements and allow town centre redevelopment.

The reasons why the Council considers it is reasonably necessary to take this interest in the land described in the Schedule are:

(a) to widen the road to cater for the additional traffic volume in Clark Street shortly to result from the termination of State Highway 20 in nearby Maioro Street; and

(b) to facilitate the redevelopment of New Lynn town centre in line with the Council’s approved strategy for the area.

The owner of the land and those persons with a registered interest in it have been served with notice of the Council’s intention to take the land and of their right to object.

Any other person having a right to object to the proposed taking of the said land may forward a written objection to the Registrar, Environment Court, Department of Courts, Level 8, 3 Kingston Street, Auckland 1010, or to PO Box 7147, Wellesley Street, Auckland 1141, within 20 working days of the date of publication of this notice.

If any objection is made in accordance with this notice, a public hearing will be held.

The objector will have a right to appear and be heard personally unless the objector otherwise requires.
