be, ceased full-time work that is self-employment; and

(b) is no longer eligible for in-work tax credits; and

(c) is in one of the following situations:

(i) the applicant, or his or her spouse or partner, is the principal caregiver of a dependent child;

(ii) in the event the applicant separates from his or her spouse or partner during the redundancy assistance period, the applicant is the principal caregiver of a dependent child.

18. Amount of assistance—The amount of a grant under clause 17 is $\$60.00$ per week for an applicant with up to 3 dependent children and an additional $\$15.00$ per week for each subsequent dependent child.

Expiry

19. Expiry—(1) No application for ReStart may be made after 31 December 2010.

(2) This programme expires with the end of the last redundancy assistance period in respect of any applicant granted ReStart on an application made prior to 1 January 2011.


Explanatory Note

This note is not part of the programme, but is intended to indicate its general effect.

This programme, which comes into effect on 1 January 2009, provides time-limited transitional assistance called ReStart to certain persons who have been made redundant from their full-time work or have lost full-time work that is self-employment and are in the process of looking for other suitable full-time work.

ReStart comprises two separate forms of assistance for eligible persons. ReCover assistance is designed to provide a form of income supplement to people with children who were eligible for in-work tax credits prior to redundancy. RePlace assistance is a form of assistance for people whose assessed rate of accommodation supplement is the maximum applicable rate to help them manage their accommodation costs following a redundancy.

ReCover and RePlace may be granted to a person either separately or together as a package depending on whether the person meets the applicable eligibility criteria. Any ReStart assistance expires at the conclusion of 16 weeks after a grant is first made in respect of either ReCover or RePlace. A grant of ReStart may be suspended because a person undertakes full-time work for up to 28 days, an employment trial for up to 90 days, or is absent from New Zealand while remaining eligible for ReStart. This period of suspension does not count in the calculation of the 16 weeks of ReStart. In these situations, ReStart will resume when the suspension ends if the person remains eligible.

Applications for assistance under the programme will be accepted until 31 December 2010. The programme expires when the last grant is made under it in respect of any such application.

Training Incentive Allowance Amendment 2008

Pursuant to section 124(1)(d) of the Social Security Act 1964, the Minister for Social Development and Employment, by this instrument, makes the following amendments to the Training Incentive Allowance Programme (as established and approved on 30 November 1998*).

Instrument

1. Title—This instrument is the Training Incentive Allowance Amendment 2008.

2. Commencement—This instrument comes into effect on the day after it is made.

3. Programme amended—This instrument amends the Training Incentive Allowance Programme.

4. Period for which this Part is effective—Clause 12(b) is amended by omitting "2008" and substituting "2009".

5. Young parent childcare payments—(1) Clause 13.1.3 is amended by adding "; and".

(2) Clause 13.1 is amended by adding the following subclause:

"13.1.4 was, immediately before the end of the 2008 school year, receiving young parent childcare payments granted under clause 13.2.".

This instrument, which comes into effect on the day after it is made, amends the Training Incentive Allowance Programme. The Teen parent pilot is extended to allow people who were receiving young parent childcare payments immediately before the end of the 2008 school year to continue to receive them during the 2009 school year or until their eligibility earlier ends.

Direction in Relation to Special Benefit Amendment 2008

Pursuant to section 5 of the Social Security Act 1964, the Minister for Social Development and Employment, by this instrument, makes the following amendment to the Direction in relation to Special Benefit given on 10 February 1999.

4. Definition of chargeable income amended—Paragraph (f)(ii) of the definition of chargeable income in clause 2.1 is amended by omitting "Defence Force Allowance Programme" and substituting "ReStart Transitional Relief Programme".
