Public Notice of Appointment of Liquidators and Notice to Creditors to Claim

Pursuant to Section 255(2)(a) of the Companies Act 1993

On 8 April 2009, it was resolved by special resolution, pursuant to section 241(2)(a) of the Companies Act 1993, that ROSELLA MARKETING LIMITED be liquidated and that Roderick T. McKenzie and Lyn M. Carey, of McKenzie & Partners Limited, Chartered Accountants, Palmerston North, be appointed liquidators.

The liquidation commenced on 8 April 2009 at 9.00am.

The liquidators have fixed 8 May 2009, as the last day for creditors to make their claims and to establish any priority their claims may have under section 312 of the Companies Act 1993.

Creditors who have not made a claim at the date a distribution is declared may be excluded from the benefit of that distribution and may not object to that distribution.

Notice to Creditors to Claim

Brendon James Gibson and Stephen Mark Lawrence were appointed joint and several liquidators of the above-named company in accordance with section 241(2)(c) of the Companies Act 1993 on 13 December 2001.

Subsequently on 12 February 2003, Grant Robert Graham replaced Stephen Mark Lawrence as joint and several liquidator of the company.

The undersigned does hereby fix 30 April 2009, as the date on or before which the creditors of the company are to make their claims and to establish any priority their claims may have, under section 312 of the Companies Act 1993, or to be excluded from the benefit of any distribution made before the debts are proved or, as the case may be, from objecting to the distribution.

Pursuant to Section 320 of the Companies Act 1993

We, Colin Thomas McCloy and Richard Dale Agnew, liquidators of MASONRY RESIDENTIAL BUILDING LIMITED, hereby give notice that, pursuant to section 318(1)(e) of the Companies Act 1993 (“the Act”) and having filed with the Registrar our final report on the liquidation, it is intended to remove the company from the New Zealand Register.

Any objection to the removal, pursuant to section 321 of the Act, must be delivered to the Registrar no later than 18 May 2009.
