Notice
- Title and commencement—(1) This notice may be cited as the Fisheries (South Island Customary Fishing) Notice (No. 3) 2009.
(2) This notice shall come into effect on 13 March 2009.
- Interpretation—In this notice:
(a) "customary food-gathering" has the same meaning as defined in the Fisheries (South Island Customary Fishing) Regulations 1999.
(b) "Tangata Tiaki/Kaitiaki" means the person or persons appointed under Regulation 9 of the Fisheries (South Island Customary Fishing) Regulations 1999 for the management of customary food-gathering within an area/rohe moana.
(c) "area/rohe moana" means an area from Waihemo to Purehurehure, extending seaward to the limit of the South Island fisheries waters as defined under Regulation 2 of the Fisheries (South Island Customary Fishing) Regulations 1999, being the 200-mile limit, and inland to boundaries defined for Kāti Huirapa ki Puketeraki under Te Rūnanga o Ngāi Tahu Act 1996.
- Nomination of Tangata Tiaki/Kaitiaki—Kāti Huirapa Rūnaka ki Puketeraki, being representative of tangata whenua holding manawhenua manamoana over the area/rohe moana (as represented by Te Rūnanga o Ngāi Tahu), has nominated Aroha Ellison and Leanne Simon as Tangata Tiaki/Kaitiaki to manage customary food-gathering in the area/rohe.
The Rūnaka has also nominated David Tohurangi Ellison, Brendan Flack, Robert Greene, Trevor Mira and Khyla Russell as Tangata Tiaki/Kaitiaki to manage customary food-gathering in the area/rohe moana for further terms.

Appointment of Tangata Tiaki/Kaitiaki—On 4 March 2009, the Minister of Fisheries (acting pursuant to a delegated authority) confirmed, under Regulation 9(1) of the Fisheries (South Island Customary Fishing) Regulations 1999, the appointment of Aroha Ellison and Leanne Simon as Tangata Tiaki/Kaitiaki to manage customary food-gathering in the area/rohe moana; and, under Regulation 9(5) of the Fisheries (South Island Customary Fishing) Regulations 1999, has reappointed David Tohurangi Ellison, Brendan Flack, Robert Greene, Trevor Mira and Khyla Russell as Tangata Tiaki/Kaitiaki to manage customary food-gathering in the area/rohe. The appointments, which will commence the day this notice comes into effect, will expire on 23 October 2013.

Power to authorise taking of fisheries resources for customary food gathering—The Tangata Tiaki/Kaitiaki may authorise any individual to take fisheries resources managed under the Fisheries Act 1996 for customary food-gathering purposes from within the whole or any part of the area/rohe moana for which they have been appointed as a Tangata Tiaki/Kaitiaki. No customary food-gathering of fisheries resources may take place in the area/rohe moana without an authorisation from a Tangata Tiaki/Kaitiaki.

Amending Notice—Appointment of New Plymouth District Council to Have the Control and Management of Okato Cemetery, New Plymouth District
Pursuant to section 23(4) of the Burial and Cremation Act 1964, and section 13 of the Interpretation Act 1999, the notice dated the 4th day of November 2008 and published in the New Zealand Gazette, 13 November 2008, No. 175, page 4522, is amended by deleting all of the land in the Schedule and substituting the same with the land in the Schedule to this notice on the date of publication of this notice in the New Zealand Gazette.
