Foundation Custodians Limited (“the mortgagee”) is the mortgagee under memorandum of mortgage 7747285.2 (Wellington Land Registry) registered on 12 March 2008 (“the mortgage”) given by ORIENTAL PARADE 360 LIMITED (“the mortgagor”) in favour of the mortgagee and affecting the land in Computer Unit Title Register 208716 (Wellington Land Registry) being the property known as 1A/370 Oriental Parade, Wellington (“the land”).

The mortgagor is in default under the mortgage and the mortgagee is entitled to appoint a receiver of the income from the land or any part of it, upon such default.

The mortgagee appointed David William Wallace, solicitor of Gibson Sheat, Lower Hutt, on 2 March 2009, to be the receiver of the income of the land with all the powers conferred upon the receiver of the income in terms of the mortgage and by the law.

The receiver of the income shall at all times be the agent of the mortgagor and not of the mortgagee.
