Pursuant to section 114 of the Public Works Act 1981, and to a delegation from the Minister for Land Information, Stephen Robert Gilbert, Land Information New Zealand, declares the land described in the Schedule to this notice to be road which, pursuant to section 88(2) of the Government Roading Powers Act 1989, becomes road, limited access road and State highway and vests in the Crown on the date of publication of this notice in the New Zealand Gazette.

Land to be Set Apart for Education (Early Childhood Education) Purposes and Grant of Easements Over Land—At Washdyke, Timaru District

Pursuant to the Public Works Act 1981, and to a delegation from the Minister for Land Information, Stephen Robert Gilbert, Land Information New Zealand:

(a) Pursuant to section 52(1), declares the land described in the First Schedule to this notice to be set apart as a site for education (early childhood education) purposes and to remain vested in Her Majesty The Queen, free of the existing subject easements created by transfers A49586.2, A49586.3 and A49586.4, and relinquishing the existing appurtenant easements created by transfer A49586.1 for the right to convey electric power and telephonic communications and the right to drain sewage but retaining the benefit of the existing appurtenant easement also created by transfer A49586.1 for a right to convey water over Lot 1 DP 61619 (Computer Freehold Register CB37A/206) marked "B" on DP 61619;

(b) Pursuant to section 52(1), declares the land described in the Second Schedule to this notice to be set apart as a site for education (early childhood education) purposes and to remain vested in Her Majesty The Queen; and

(c) Pursuant to section 28, further declares the land described in the First Schedule to this notice is set apart subject to the creation of the following easements, on terms and conditions as set out in Schedule 4 to the Land Transfer Regulations 2002:

(i) A right of way over the said land marked "A" on SO 413978 appurtenant to the land in the Third Schedule hereto; and

(ii) a right to drain sewage appurtenant to the said land over the land marked "C" on SO 413978 and for a right to convey water appurtenant to the said land over the land marked "B" on SO 413978 and "A", "C" and "J" on DP 61619, all being easements over the land in the Third Schedule hereto on the date of publication of this notice in the New Zealand Gazette.
