Regulations 1999 for the management of customary food-gathering within an area/rohe moana.

(c) “area/rohe moana” means the area from the South Shore Spit extending seaward following the adjoining area/rohe moana boundary line of Te Hapū o Ngāti Wheke ki Rāpaki Tangata Tiaki/Kaitiaki out to the 12 nautical-mile limit; then south following the offshore boundary set for the Canterbury Rūnanga out to the limit of the “South Island fisheries waters” as defined in Regulation 2 of the Fisheries (South Island Customary Fishing) Regulations 1999; then following the boundary of the “South Island fisheries waters” northwards to a point where it meets the adjoining area/rohe moana boundary line of Te Rūnanga o Kaikōura Tangata Tiaki/Kaitiaki; and then following the rohe moana boundary line back to the southern bank of the Hurunui River; and then inland following the boundaries set for Te Ngāi Tūāhuriri Rūnanga under the First Schedule of Te Rūnanga o Ngāi Tahu Act 1996 (excluding the areas shared with other papatipu rūnanga); and then along the bottom contours of the Port Hills (including the city of Christchurch) back to South Shore Spit (including the Estuary of the Heathcote and Avon Rivers/Ihutai).

3. Nomination of Tangata Tiaki/Kaitiaki—Te Ngāi Tūāhuriri Rūnanga, being the tangata whenua holding manawhenua manamoana over the area/rohe moana (as represented by Te Rūnanga o Ngāi Tahu), has nominated William Edward Dawson, Justin Fowler, Te Marino Lenihan, Arapata Hohepa Te Au Reuben, Makarini Rupene (Reuben), Ben Te Aika-Speke and Cherie Williams as Tangata Tiaki/Kaitiaki for managing customary food-gathering within the area/rohe moana.

4. Appointment of Tangata Tiaki/Kaitiaki—On 16 November 2009, the Minister of Fisheries confirmed, under Regulation 9(1) of the Fisheries (South Island Customary Fishing) Regulations 1999, the appointment of William Edward Dawson, Justin Fowler, Te Marino Lenihan, Arapata Hohepa Te Au Reuben, Makarini Rupene (Reuben), Ben Te Aika-Speke and Cherie Williams as Tangata Tiaki/Kaitiaki for managing customary food-gathering within the area/rohe moana. The appointments will expire on 19 November 2014.

5. Power to authorise the taking of fisheries resources for customary food-gathering—A Tangata Tiaki/Kaitiaki may authorise any individual to take fisheries resources managed under the Fisheries Act 1996 for customary food-gathering purposes from within the whole or any part of the area/rohe moana for which they have been appointed as a Tangata Tiaki/Kaitiaki. No customary food-gathering of fisheries resources may take place in the area/rohe moana without an authorisation from a Tangata Tiaki/Kaitiaki.
