Any animal moved in contravention of this notice may be seized by an inspector or authorised person and destroyed, treated or otherwise dealt with, if it is reasonable in the circumstances to do so. The Animal Health Board Incorporated may also recover the cost of testing for bovine tuberculosis pursuant to the Biosecurity Act 1993 and the Biosecurity (Deer and other testing costs) Regulations 1998.

Failure to comply with the requirements of this notice may result in prosecution under the Biosecurity Act 1993. If convicted, an individual will be liable to a term of imprisonment not exceeding five years, or a fine not exceeding $100,000.00, or both. A corporation convicted of an offence is liable to a fine not exceeding $200,000.00.
Revocation
The declaration issued on 1 February 2008, in regard to movement controls for bovine tuberculosis and published in the New Zealand Gazette, 7 February 2008, No. 17, page 405 and in Straight Furrow on 12 February 2008, is hereby revoked, with effect from 1 March 2009.
Summary of Changes
This declaration has the effect of revoking parts of the following Controlled Areas:
- Part of the Tasman/West Coast Controlled Area is revoked east of the Motueka River in Tasman District.
- The previous Hakataramea Controlled Area in the Canterbury Region is revoked and replaced by the North Aviemore Controlled Area. This has the effect of removing the Hakataramea Valley from the Controlled Area.

Preamble
The variations set forth in the Schedule below are variations to Standards in the Australia New Zealand Food Standards Code published by the National Health and Medical Research Council in the Commonwealth of Australia Gazette, No. P 27, on 27 August 1987, which have been varied from time to time.
Citation
These variations may be collectively known as the Australia New Zealand Food Standards Code – Amendment No. 106 – 2009.
Commencement
These variations commence on 12 February 2009.
