Notice

  1. Title—This notice may be cited as the Fisheries (Coromandel Scallop Total Allowable Catch) Notice 2009.

  2. Commencement—This notice shall come into effect the day after the date of its notification in the New Zealand Gazette.

  3. Coromandel Scallop Fishery defined—The Coromandel Scallop Fishery quota management area is the area as defined in Schedule 4 of the Fisheries (Declaration of New Stock Subject to Quota Management System) Notice 2001.

  4. Total allowable catch for the Coromandel Scallop Fishery increased for 2009–10 fishing year—The total allowable catch for the Coromandel Scallop Fishery for the 2009–10 fishing year is increased to 155 tonnes meatweight in accordance with section 13(7) of the Fisheries Act 1996.

  5. Total allowable catch for the Coromandel Scallop Fishery reverts—From 1 April 2010, the total allowable catch for the Coromandel Scallop Fishery reverts back to 48 tonnes meatweight in accordance with section 13(8) of the Fisheries Act 1996.

Fisheries (Kaimoana Customary Fishing) Regulations 1998

Fisheries (Kaimoana Customary Fishing) Notice (No. 5) 2009 (No. F499)

Pursuant to Regulation 9 of the Fisheries (Kaimoana Customary Fishing) Regulations 1998, the Programme Manager (Deed of Settlement Implementation Programme) at the Ministry of Fisheries (acting pursuant to a delegated authority in accordance with section 41 of the State Sector Act 1988) gives the following notice.

  1. Title and commencement—(1) This notice may be cited as the Fisheries (Kaimoana Customary Fishing) Notice (No. 5) 2009.

(2) This notice shall come into effect on 4 September 2009.

  1. Interpretation—In this notice:

    (a) “customary food-gathering” has the same meaning as defined in Regulation 2 of the Fisheries (Kaimoana Customary Fishing) Regulations 1998.

    (b) “Tangata Kaitiaki” are local dialect words that have the same meaning as “Tangata Kaitiaki/Tiaki”, a term that is defined in Regulation 2 of the Fisheries (Kaimoana Customary Fishing) Regulations 1998.

    (c) “Tangata Kaitiaki” means the person or persons appointed under Regulation 9 of the Fisheries (Kaimoana Customary Fishing) Regulations 1998 for the management of customary food-gathering within the area/rohe moana.

    (d) “area/rohe moana” means the area described by a line commencing at Ninepin Rock (Te To Ka Tapu a Kupe) (37°03.03'S 174°30.22'E); then proceeding in a straight line generally east to the navigational light “Manukau Heads Signal Station” (37°03.20'S 174°32.70'E); then proceeding generally south following the mean high-water mark to a point on the northern side of the mouth of the Waikato River (37°21.10'S 174°41.33'E); then proceeding due west for 200 nautical miles to a point on the outer limit of the Exclusive Economic Zone; then proceeding generally northerly following the outer limit of the Exclusive Economic Zone to a point due west of Ninepin Rock (Te To Ka Tapu a Kupe); then proceeding due east for 200 nautical miles to Ninepin Rock (Te To Ka Tapu a Kupe) being the point of commencement. The geographical coordinates named are in terms of the WGS84 datum.

  2. Nomination of Tangata Kaitiaki—Ngāti Te Ata has nominated Kenneth Edwards, Perakihi Edwards, Te Aho Edwards, Mahara Kaihau, Arataki Minhinnick, Jackie Minhinnick, Riki Minhinnick, George Nepia, Tom Nepia, Tihema Ngerengere, Watene Ngerengere, Mark Puke, Pikirangi Taylor, Corina Tawhiao and Frankie Tawhiao as Tangata Kaitiaki to manage customary food-gathering within the area/rohe moana.

  3. Appointment of Tangata Kaitiaki—On 24 August 2009, the Minister of Fisheries confirmed, under Regulation 9(1) of the Fisheries (Kaimoana Customary Fishing) Regulations 1998, the appointment of Kenneth Edwards, Perakihi Edwards, Te Aho Edwards, Mahara Kaihau, Arataki Minhinnick, Jackie Minhinnick, Riki Minhinnick, George Nepia, Tom Nepia, Tihema Ngerengere, Watene Ngerengere, Mark Puke, Pikirangi Taylor, Corina Tawhiao and Frankie Tawhiao as Tangata Kaitiaki for managing customary food-gathering within the area/rohe moana.

  4. Confirmation of tangata whenua—Ngāti Te Ata is confirmed as tangata whenua for the area/rohe moana.

  5. Power to authorise the taking of fisheries resources for customary food-gathering—A Tangata Kaitiaki appointed for the area/rohe moana may authorise any individual to take fisheries resources managed under the Fisheries Act 1996 for customary food-gathering purposes from within the whole or any part of the area/rohe moana. No customary food-gathering of fisheries resources may take place in the area/rohe moana without an authorisation from a Tangata Kaitiaki.
