(2) A Tangata Kaitiaki appointed for a mātaitai reserve may authorise any individual to take fisheries resources managed under the Fisheries Act 1996, other than those resources that are taken in fresh water, for customary food-gathering purposes from within the whole or any part of a mātaitai reserve. No customary food-gathering of fisheries resources may take place in a mātaitai reserve without an authorisation from a Tangata Kaitiaki.

Fisheries (Kaimoana Customary Fishing) Notice (No. 3) 2009 (No. F491)

Pursuant to Regulation 9 of the Fisheries (Kaimoana Customary Fishing) Regulations 1998, the Programme Manager (Deed of Settlement Implementation Programme) at the Ministry of Fisheries (acting pursuant to a delegated authority in accordance with section 41 of the State Sector Act 1988) gives the following notice.

Notice

  1. Title and commencement—(1) This notice may be cited as the Fisheries (Kaimoana Customary Fishing) Notice (No. 3) 2009.

(2) This notice shall come into effect on 17 July 2009.

  1. Interpretation—In this notice:

(a) “customary food-gathering” has the same meaning as defined in Regulation 2 of the Fisheries (Kaimoana Customary Fishing) Regulations 1998.

(b) “Tangata Kaitiaki” are local dialect words that have the same meaning as “Tangata Kaitiaki/Tiaki”, a term that is defined in Regulation 2 of the Fisheries (Kaimoana Customary Fishing) Regulations 1998.

(c) “Tangata Kaitiaki” means the person or persons appointed under Regulation 9 of the Fisheries (Kaimoana Customary Fishing) Regulations 1998 for the management of customary food-gathering within the area/rohe moana.

(d) “area/rohe moana” means the area described by a line commencing at a point on the line of mean high-water springs at Papanui Point (37°53.12’S 174°45.39’E), then proceeding in a north-easterly direction following the line of mean high-water springs in and around Raglan Harbour and up to a point at Waipohutukawa (37°43.34’S 174°49.30’E), then due west for 200 nautical miles to a point on the line of the Exclusive Economic Zone, then following the line of the Exclusive Economic Zone south to a point due west of Papanui Point, then due east for 200 nautical miles to Papanui Point being the point of commencement. The geographical coordinates named are in terms of the WGS84 datum.

  1. Nomination of Tangata Kaitiaki—Ngāti Tamainupo, as represented by Mai Uenuku Ki Te Whenua Marae, has nominated Quinton Craig Moore as a Tangata Kaitiaki for managing customary food-gathering in the area/rohe moana.

  2. Appointment of Tangata Kaitiaki—On 30 June 2009, the Minister of Fisheries confirmed, under Regulation 9(1) of the Fisheries (Kaimoana Customary Fishing) Regulations 1998, the appointment of Quinton Craig Moore as a Tangata Kaitiaki for managing customary food-gathering within the area/rohe moana.

  3. Power to authorise the taking of fisheries resources for customary food-gathering—The Tangata Kaitiaki appointed for the area/rohe moana may authorise any individual to take fisheries resources managed under the Fisheries Act 1996, other than those resources that are taken in fresh water, for customary food-gathering purposes from within the whole or any part of the area/rohe moana. No customary food-gathering of fisheries resources may take place in the area/rohe moana without an authorisation from a Tangata Kaitiaki.

Fisheries (Satellite Vessel Monitoring) Regulations 1993

The Fisheries (Revocation of Satellite Vessel Monitoring Circular) Notice 2009 (No. F486)

Under Regulation 5(8) of the Fisheries (Satellite Vessel Monitoring) Regulations 1993, the National Manager Fisheries Compliance of the Ministry of Fisheries, acting pursuant to a delegated authority in accordance with section 41 of the State Sector Act 1988, gives the following notice.

Notice

  1. Title—This notice may be cited as the Fisheries (Revocation of Satellite Vessel Monitoring Circular) Notice 2009.

  2. Commencement—This notice shall come into effect on the date of its notification in the New Zealand Gazette.

  3. Revocation of certification requirements—Circular 2, “Certification requirements for ARGOS Automatic Location Communicators”, issued on the 8th day of December 1993 under Regulation 4 of the Fisheries (Satellite Vessel Monitoring) Regulations 1993, is revoked.

  4. Revocation of type approval—Under Regulation 5(8) of the Fisheries (Satellite Vessel Monitoring) Regulations 1993, the Fisheries (Automatic Location Communicator Type Approval) Notice (No. 3) 1994 (No. 5340) notified in the New Zealand Gazette, 14 April 1994, No. 33, page 1330, and the type approval contained in that notice granted to the following ARGOS device, is revoked:
