other than the member.
In accordance with Rule 21.35 of the Rules of the Institute
of Chartered Accountants of New Zealand, the decision of
the disciplinary tribunal will automatically be published
in the Chartered Accountants Journal and on the institute’s
website, and the tribunal directed that the decision be
published in the New Zealand Gazette with mention of the
member’s name and locality.

Right of Appeal

Pursuant to Rule 21.41 of the Rules of the Institute of
Chartered Accountants of New Zealand, which were in force
at the time of the original notice of complaint, the member
may, not later than 14 days after the notification of this
tribunal to the member of the exercise of its powers, appeal
in writing to the appeals council of the institute against the
decision.

No decision other than the direction as to publicity shall take
effect while the member remains entitled to appeal or while
any such appeal by the member awaits determination by the
appeals council.

Notice of Controlled Area, Movement Controls and Procedures in Respect of Unwanted Organism
Varroa destructor

  1. Commencement—This notice takes effect at 4pm on Thursday, 31 January 2008, and replaces the notice dated the 27th
    day of June 2005 and published in the New Zealand Gazette, 30 June 2005, No. 100, page 2397.

  2. Controlled area declaration—Pursuant to section 131(2) of the Biosecurity Act 1993, I hereby declare all parts of
    New Zealand that fall within the area described as:

“All parts of New Zealand that fall within the boundaries of the local government regions of Northland, Auckland, Waikato,
Bay of Plenty, Gisborne, Taranaki, Hawke’s Bay, Manawatu-Wanganui, and Wellington”

to be an area that is controlled for the purpose of limiting the spread of Varroa bee mite (Varroa destructor, formerly known as
Varroa jacobsoni), being an unwanted organism under the Biosecurity Act 1993.\n
This area is referred to as “the controlled area” in the rest of this notice.

A map of the area described is displayed in Schedule 2 below.

  1. Notice of movement controls—Pursuant to section 131(3)(a) of the Biosecurity Act 1993, I hereby give notice that:

The movement of the things listed in Schedule 1 below from any part of the controlled area to any part of New Zealand not
in the controlled area is prohibited, except with the permission of an inspector or authorised person appointed under the
Biosecurity Act 1993.

Schedule 1

Things Subject to Movement Control

(a) Honey bees (meaning Apis mellifera), alive or dead, at any stage of development, including live beehives, nucleus colonies,
frames of bee brood, queen bees and escorts, package bees and bulk bees.

(b) Used beehives (meaning anything that is being or has been used for the keeping of honey bees), including any part of any
beehive.

(c) Unused beehives containing wax foundation or plastic frames covered with beeswax.

(d) Unprocessed beeswax, propolis and pollen, and any honey that is not packaged for retail sale.

(e) Used beekeeping equipment.

(f) Anything upon which, or within which, the varroa mite, dead or alive, is present.

(g) Vehicles, which are used for the purpose of visiting apiary sites and transporting anything listed from (a) to (e) in this
Schedule (“beekeeping vehicles”).

(h) Unprocessed logs (logs that have been felled with no further processing).

(i) Bulk wine grapes.

(j) Buildings (complete structures such as a house but not including portacoms).
