where the primary objective is the promotion of
Māori language and culture; or
(v) implementing new television broadcasting services
in the range of frequencies 614 MHz to 646 MHz,
where such services are undertaken otherwise than
for profit; or
(vi) facilitating the short-term operation of nonbroadcasting services in the range of frequencies
494 MHz to 518 MHz for specific events.
In granting applications for radio licences for television
services under subsection (v), you shall have regard to the
following matters:
- The extent to which the proposed service contributes
to Government’s broadcasting objectives. - The extent to which the proposed service is
consistent with the definition of a non-commercial
broadcaster. - The capability of the proposed service to commence
within two years. - The extent to which the proposal increases the
diversity of programme choice for viewers. - The extent to which a proposal can provide
non-commercial services not being provided on a
national level. These may include parliamentary
broadcasts, educational services such as foreign
language programming, religious programming,
coverage of minority sports, and New Zealand
documentaries and short films. - The extent to which the proposal provides access to
local and regional programme makers. - The extent of geographic coverage possible for
non-commercial services, given spectrum capacity. - The extent to which time is made available for
non-commercial uses, including prime time. - The extent to which the proposal can demonstrate
that its overall objective is “not for profit”. - The prospect that the proposal will be implemented.
- The extent to which the proposal contains
sufficient accountability mechanisms to ensure
that it delivers on its undertakings to provide
services. Arrangements may include:
A. mechanisms for equitable allocation of air
time amongst all interested users;
B. procedures for resolving disputes over
allocation of time to users;
C. systems for ensuring efficient management
of services;
D. provision of satisfactory services to the
full variety of audiences to be catered for;
E. mechanisms for ensuring compliance by all
users on the frequency with broadcasting
standards. - Any potential future public benefit from providing
for the transition of services to digital transmission. - Any other benefits the proposal may offer.
- Application of this notice—You shall comply with the
directions set out above in relation to all applications for
radio licences, including applications made before the date
of this notice but not dealt with before that date. - Revocation of previous notices—All previous statements
of Government policy made pursuant to section 112 of the
Act are hereby revoked.

Appointments to the Career Services Board
Pursuant to section 281 of the Education Act 1989, and
section 28 of the Crown Entities Act 2004, I appoint
Carl Pascoe
Tina Wehipeihana-Wilson
as members of the Career Services Board.
These appointments will commence on 1 January 2008 and
expire on 31 December 2010.

Fisheries (Kaimoana Customary Fishing) Notice
(No. 5) 2008 (No. F446)
Pursuant to Regulation 9 of the Fisheries (Kaimoana
Customary Fishing) Regulations 1998, the Programme
Manager (Deed of Settlement Implementation Programme)
at the Ministry of Fisheries (acting pursuant to a delegated
authority in accordance with section 41 of the State Sector
Act 1988) gives the following notice.
Notice
- Title and commencement—(1) This notice may be
cited as the Fisheries (Kaimoana Customary Fishing) Notice
(No. 5) 2008.
(2) This notice shall come into effect the day after the date
of its notification in the New Zealand Gazette. - Interpretation—In this notice:
(a) “customary food-gathering” has the same meaning as
defined in Regulation 2 of the Fisheries (Kaimoana
Customary Fishing) Regulations 1998.
(b) “Tangata Kaitiaki” are local dialect words that
have the same meaning as “Tangata Kaitiaki/Tiaki”,
a term that is defined in Regulation 2 of the Fisheries
(Kaimoana Customary Fishing) Regulations 1998.
(c) “Tangata Kaitiaki” means the person or persons
appointed under Regulation 9 of the Fisheries
(Kaimoana Customary Fishing) Regulations 1998
for the management of customary food-gathering
within the area/rohe moana.
(d) “area/rohe moana” means all that area of water
enclosed by a line commencing at the mean
high-water springs at the mouth of the Whareama
River (41°01.00′S 176°06.50′E); then proceeding
due east to the 12 nautical mile limit to a point
at latitude 41°01.00′S; then proceeding generally
south-west along the 12 nautical mile limit to a point
at latitude 41°23.10′S; then proceeding due west to a
point north of the Pahaoa River mouth (41°23.10′S
175°45.20′E); then proceeding generally north-east
along the mean high-water springs to the point of
