Network
- Conditions—This exemption is granted on the following
conditions:
(a) Each of the exempted traders must provide the
reconciliation manager with submission information
for each reconciliation cycle, for each of the
unmetered points of connection, based on permanent
estimates in compliance with the Rules; and
(b) it will expire on 30 April 2010. - Reasons for granting the exemption—The reasons for
granting this exemption are:
(a) Without an exemption, the traders at each of the
unmetered points of connection will incur significant
expenditure in fitting a metering installation;
(b) the historical nature of the connections and
impracticability of complying strictly with the
Rules; and
(c) the exemption will have little or no impact on other
participants and service providers and will not affect
any other rules.

Electricity Governance Regulations (Exemption
No. 67 (The Reconciliation Manager))
Exemption Notice 2008
Pursuant to Regulation 194(2) of the Electricity
Governance Regulations 2003, the Electricity Commission
(“Commission”) gives the following notice.
Notice
- Title and commencement—(1) This notice is
the Electricity Governance Regulations (Exemption
No. 67 (The Reconciliation Manager)) Exemption Notice -
(2) This notice comes into force on 1 May 2008.
- Exemption—The Reconciliation Manager (“RM”) is
exempted from compliance with Rule 10 of Schedule J4 of
Part J of the Electricity Governance Rules 2003 (“Rules”). - Conditions—This exemption is granted on the following
conditions:
(a) It only applies to the following networks:
(i) Tuaropaki;
(ii) Atiamuri;
(iii) Aniwhenua;
(iv) New Zealand Steel;
(v) Southpark; and
(vi) Tararua Wind Farm.
(b) It is subject to the RM allocating all unaccounted for
electricity (“UFE”), on each of the networks listed
above, to the corresponding unmetered installation
control point listed below;

4. Reasons for granting the exemption—The reasons for
granting this exemption are:

at the unmetered points of connection listed above)
on each network will incur significant expenditure
with the allocation of UFE;
(b) the historical nature of the connections and
impracticability of complying strictly with the
Rules; and
(c) the exemption will have little or no impact on other
participants and service providers and will not affect
any other rules.

Electricity Governance Regulations (Exemption
No. 79 (Energy Online Limited)) Exemption
Notice 2008
Pursuant to Regulation 194(2) of the Electricity
Governance Regulations 2003, the Electricity Commission
(“Commission”) gives the following notice.
Notice
- Title and commencement—(1) This notice is the
Electricity Governance Regulations (Exemption No. 79
(Energy Online Limited)) Exemption Notice 2008.
(2) This notice comes into force on 1 May 2008. - Exemption—Energy Online Limited (“Energy Online”)
is exempted from compliance with the requirement in Rule
2.4.3 of Part H of the Electricity Governance Rules 2003
(“Rules”) that a third party guarantor maintains an acceptable
credit rating as defined in Rule 2.5 of Part H of the Rules. - Conditions—This exemption is granted on the following
conditions:
(a) Energy Online must procure an unconditional third
party guarantee, as required by Rule 2.4.3 of Part H
of the Rules, from Genesis Power Limited
(“Genesis”);
(b) Genesis must enter into a deed in favour of and
enforceable by the clearing manager providing that
the clearing manager may set-off any amount owing
by Genesis under that third party guarantee against
any amount payable by the clearing manager to
Genesis as if Rule 9.4.3 of Part H of the Rules
applied to that amount owed by Genesis;
(c) Genesis must ensure that any acceptable security
that it provides from time to time under Rule 2.2.2
of Part H of the Rules secures its obligations
under the third party guarantee that it provides under
paragraph (a) of this clause in addition to its own
obligations; and
(d) Genesis must at all times maintain a minimum level
of security under paragraph (c) of this clause that
