  • rotationally moulded tanks;
  • diesel tanks up to 2500 litres capacity on farms to have
    nil secondary containment; and

    buildings.

Notice of Intention to Apply for Approval of Code
of Practice

Pursuant to section 79 of the Hazardous Substances and
New Organisms Act 1996, the Environmental Risk
Management Authority gives notice that the Pest
Management Association of New Zealand (Inc) intends to
apply for the approval of a Code of Practice for the Control
and Safe Use of Fumigants.

Parts One and Two of this code provide a means of
compliance with the Hazardous Substances and New
Organisms Regulations and transfer notices, for fumigants
listed in the Hazardous Substances (Fumigants) Transfer
Notice 2004.

Part Three provides a summary of requirements under the
Health and Safety in Employment Act 1992 and other
legislation.

The document provides a means of compliance against
current legislation.

It does not change or override the current legislation, nor
does it cover fumigants that are not listed in the Hazardous
Substances (Fumigants) Transfer Notice.

Written submissions in relation to the approval of this code
can be made by mail, facsimile or email to the contacts
below.

Submissions close on 22 May 2008.

The draft code will be available from the Wellington Office
of ERMA New Zealand, Level 1, BP House, 20 Customhouse
Quay, Wellington, from 22 April 2008 and can be inspected
at that office.

Land Transport Rule: Light-vehicle
Brakes 2002

Approval of Brake Testing Device

Pursuant to subclause 4.6(1) of Land Transport Rule:
Light-vehicle Brakes 2002 (“the Rule”), and pursuant to
the powers delegated to me by the Director of Land
Transport, I, Laszlo Andras Hidvegi, Principal Vehicle
Engineer, hereby approve the brake testing device specified
in the Schedule to this notice for the purpose of measuring
brake forces of vehicles to establish compliance with the
requirements for light-vehicle brakes contained in the Rule.

Notice for the Matters to be Included in a Plan
Summary—Education (Matters That an
Organisation That Has a Plan Must Include in a
Plan Summary) Notice 2008

Pursuant to section 159YO(1) of the Education Act
1989 (“the Act”), the Tertiary Education Commission
(“the TEC”) gives the following notice:

Notice

  1. Title—This notice may be cited as the Education
    (Matters That an Organisation That Has a Plan Must Include
    in a Plan Summary) Notice 2008.

  2. Commencement—This notice applies from the date of
    its publication and remains in force until such time it is
    revoked and replaced.

  3. Introduction—Subsection 159YO(1) of the Act requires
    the TEC to prescribe and give public notice of the matters
    that an organisation that has a Plan must include in a Plan
    summary.

  4. Subsection 159YO(2) of the Act states an organisation
    that has a Plan must ensure that:

(a) a Plan summary is available for inspection by the
public;

(b) copies of that Plan summary may be obtained either
at no cost or no more than a reasonable cost; and

(c) the Plan summary contains the matters prescribed
under subsection (1).

  1. Plan summary content requirements—The following
    parts of a Plan must be made available for public inspection
    with the proviso that an organisation may exclude
    information that might otherwise be withheld in accordance
    with the Official Information Act 1982:

(i) Plan Context (this section establishes the framework
for the rest of the Plan)

Outline of the particular factors the organisation has
considered and intends to respond to in its agreed
Plan, including:

  • Government priorities in the Tertiary Education
    Strategy 2007–12 (TES) including the distinctive
    contribution expected of the type of organisation;
  • needs and priorities of students and other
    stakeholders; and
  • areas for organisational capability development
    (including those for the delivery of quality
    education and research).
