Notice of Entry into Possession of Mortgaged Goods

In the matter of the Property Law Act 2007, and in the
matter of the mortgage over goods ("the security
agreement") dated the 24th day of June 2005 over the
following mortgaged goods ("the collateral"):

1992 20 tonne Hitachi Excavator with general purpose
bucket, wide bucket-grapple, quick-hitch, serial number
147-64266, engine number 6BDI-715923.

LDC Finance Limited (in receivership), the mortgagee
under the security agreement, gives notice that the
mortgagee has taken possession of the collateral on
29 February 2008.

Unclaimed Property

Notice of Election to Manage Property

Pursuant to section 101(1) of the Public Trust Act 2001,
Public Trust hereby gives notice that:

(a) Alexander Chalmers, gentleman, of Wakari, who died
on or about 2 July 1864, is the owner of the property
described in the Schedule hereto.

(b) Public Trust elects to become manager of the property,
it being satisfied that it is advisable in terms of section
101(1) of the above Act.

Schedule

A portion of land intended to be used as road some
505 metres long and 10 metres wide stretching between
Dalziel and Taieri Roads, Halfway Bush, Dunedin, being an
estate in fee simple containing 5650 square metres, part
Sections 28, 32, 34, 36 and 38, Wakari Survey District,
balance Deeds Index Q399 (Otago Registry).

Education Act 1989

Notice of Rent Scheme for Teachers’ Residences

Pursuant to section 88A of the Education Act 1989, I prescribe
the rent scheme for teachers’ residences as follows:

  • A teacher or principal who is provided with residential
    accommodation under a service tenancy agreement by
    reason of his or her employment as a teacher or principal
    at a school must pay rent to the board of trustees of the
    school which is 75% of the market rent for the residence.

("Market rent" is the rent that, without regard to the
personal circumstances of the landlord or the tenant, a
willing landlord might reasonably expect to receive and
a willing tenant might reasonably expect to pay for the
tenancy, taking into consideration the general level of
rents for comparable tenancies of comparable premises
in the locality or in similar localities, as determined by
a registered valuer or other competent agency retained
by the board of trustees for that purpose.)

This notice takes effect the day after the date of publication.

Notice of Direction to Appoint a Limited Statutory Manager for the Board of Trustees of Opononi Area School (11)

Pursuant to section 78M of the Education Act 1989, I direct
the Secretary for Education to appoint a limited statutory
manager for the Opononi Area School Board of Trustees
because of the risks to the operation of the school and the
educational performance of the students at the school.

The following functions, powers and duties of the board are
to be vested in a limited statutory manager:

  • All functions, powers and duties of the board as an
    employer (whether statutory or otherwise); and
