Notice of Entry into Possession of Mortgaged Properties

To: Begley Properties Limited, 4 John Rymer Place, Kohimarama, Auckland.

In the matter of section 156 of the Property Law Act 2007, and in the matter of mortgage instrument 7137914.3 (Hawke’s Bay Registry) (“the mortgage”):

TEA Custodians (Bluestone) Limited, (“the mortgagee”) under the mortgage, gives notice as follows:

1. On 6 March 2008, the mortgagee under the mortgage, entered into possession of the mortgaged properties.

2. The description of the mortgaged properties are Unit 2D DP 356521 in Computer Unit Title Register 230434 (Hawke’s Bay Registry), being the property at Unit 2D, 3 Shakespeare Road, Napier, Unit 2E DP 356521 in Computer Unit Title Register 230435 (Hawke’s Bay Registry), being the property at Unit 2E, 3 Shakespeare Road, Napier, Unit 2G DP 356521 in Computer Unit Title Register 230437 (Hawke’s Bay Registry), being the property Unit 2G, 3 Shakespeare Road, Napier, and Unit 2H DP 356521 in Computer Unit Title Register 230438 (Hawke’s Bay Registry), being the property Unit 2H, 3 Shakespeare Road, Napier.

3. The address of the mortgagee’s registered office is Level 5, 10 Customhouse Quay, Wellington.

Notice of Entry into Possession of Mortgaged Property

Pursuant to Sections 137, 139 and 156 of the Property Law Act 2007

Notice is hereby given that:

1. PMIT Nominees Limited, as mortgagee under mortgage 7336494.1 (“the mortgage”) over the property located at Residence 7, Park Bridge, 138–146 Park Terrace, Christchurch, described in Computer Freehold Register 310030 (Canterbury District) (“the property”), applied to the High Court at Christchurch on 10 March 2008, for an order that possession of the property be granted to the mortgagee and the Court duly made this order; and

2. The mortgagee is therefore deemed to have entered into possession of the property on 10 March 2008.

This notice is given by the solicitors for the mortgagee, whose address for service is at the offices of Harkness Henry & Co, Solicitors, 7th/8th Floors, KPMG Centre, 85 Alexandra Street, Hamilton.

Education Act 1989

Notice of Direction to Appoint a Limited Statutory Manager for the Board of Trustees of Manurewa Intermediate School (1353)

Pursuant to section 78M of the Education Act 1989, I direct the Secretary for Education to appoint a limited statutory manager for the Manurewa Intermediate School Board of Trustees because of the risks to the operation of the school and the educational performance of the students at the school.

The following functions, powers and duties of the board are to be vested in a limited statutory manager:

• All functions, powers and duties of the board as an employer (whether statutory or otherwise).

A limited statutory manager must also advise the board on the following matters:

• Board organisation and management; and
• ensuring areas for improvement identified in the current, and any future, Education Review Office reports are implemented.

This notice takes effect the day after the date of publication.

Notice of Dissolution of the Board of Trustees of Kakatahi School (2375) and Direction to Appoint a Commissioner, and Revocation of Notice of Direction to Appoint a Limited Statutory Manager for the Board of Trustees of Kakatahi School (2375)

Pursuant to section 78N(1) of the Education Act 1989, I hereby dissolve the board of trustees of Kakatahi School (2375) and direct the Secretary for Education to appoint a commissioner to replace that board because of the risks to the operation of the school.

As a consequence of this action, the notice of direction to appoint a limited statutory manager for the board of trustees of Kakatahi School (2375) (as published in the New Zealand Gazette, 6 April 2006, No. 33, page 841) is hereby revoked under section 78M(7) of the Education Act 1989.
