Declaration by Chief Electoral Officer That
Dail Michael John Jones is Elected a Member of Parliament

WHEREASβ€”

A. I have received a warrant from His Excellency the Governor-General of New Zealand to supply a member of Parliament to fill a vacancy created by the resignation of Brian John Donnelly, pursuant to section 55(1)(f) of the Electoral Act 1993;

B. Under section 137(2) of the Electoral Act 1993, I have determined that of the unelected candidates on the party list of the New Zealand First Party, Susan Joan Baragwanath stood highest in the order of preference on that list;

C. Under section 137(3) of that Act, I have asked the Secretary of the New Zealand First Party whether Susan Joan Baragwanath remains a member of that party and I have been informed that she remains a member of that party;

D. Under section 137(4) of that Act, I have asked Susan Joan Baragwanath whether she is willing to be a member of Parliament, and she has indicated that she is not willing to be a member of Parliament;

E. Under section 137(5) of that Act, I have identified that of the unelected candidates on the party list of the New Zealand First Party, James Leonard Peters stood the next highest in the order of preference on that list;

F. Under section 137(3) of that Act, I have asked the Secretary of the New Zealand First Party whether James Leonard Peters remains a member of that party and I have been informed that he remains a member of that party;

G. Under section 137(4) of that Act, I have asked James Leonard Peters whether he is willing to be a member of Parliament, and he has indicated that he is not willing to be a member of Parliament;

H. Under section 137(5) of that Act, I have identified that of the unelected candidates on the party list of the New Zealand First Party, Dail Michael John Jones stood the next highest in the order of preference on that list;

I. Under section 137(3) of that Act, I have asked the Secretary of the New Zealand First Party whether Dail Michael John Jones remains a member of that party and I have been informed that he remains a member of that party;

J. Under section 137(4) of that Act, I have asked Dail Michael John Jones whether he is willing to be a member of Parliament, and he has indicated that he is willing to be a member of Parliament.

THEREFORE, pursuant to section 137(5) of that Act, I, Robert Andrew Peden, Chief Electoral Officer, declare that

Dail Michael John Jones

is elected as a member of Parliament by publication of this declaration as a Supplement to the New Zealand Gazette.
