COMMERCE ACT (NEW ELECTRICITY INFORMATION DISCLOSURE AMENDMENT REQUIREMENTS) NOTICE 2008
Pursuant to section 57T(4)(a) of the Commerce Act 1986
The following Requirements were made by the Commerce Commission on the 19th day of December 2008:
(a) the Electricity Information Disclosure Amendment Requirements (No. 4) 2008 (the "2004 Amendment Requirements");
(b) the Electricity Distribution (Information Disclosure) Amendment Requirements 2008 (the "Distribution Amendment Requirements").
2004 Amendment Requirements
The 2004 Amendment Requirements amend requirement 4B(1) of the Electricity Information Disclosure Requirements 2004, as previously amended, (the "2004 Requirements") to extend, from 28 February 2009 to 10 April 2009, the date by which disclosing entities must publish and publicly disclose certain information in respect of the financial year that ended on 31 March 2008.
The 2004 Amendment Requirements also amend requirement 19 of the 2004 Requirements to provide that a disclosing entity need not publish and publicly disclose a valuation report relating to its line business system fixed assets if it has previously published and publicly disclosed a valuation report relating to its line business system fixed assets that complies with subclauses (5), (6), and (7) of requirement 19 and has a valuation date after 31 March 2003.
Distribution Amendment Requirements
The Distribution Amendment Requirements amend requirement 19 of the Electricity Distribution (Information Disclosure) Requirements 2008 (the "Distribution Requirements") to extend, from 28 February 2009 to 10 April 2009, the date by which distribution businesses must publish and publicly disclose certain information in respect of the financial year that ended on 31 March 2008.
