Land Transport Rule: Heavy-vehicle Brakes 2006

Approval of Computer Software

Pursuant to subclause 10.6(8) of Land Transport Rule: Heavy-vehicle Brakes 2006 (“the Rule”), and pursuant to the powers delegated to me by the Director of Land Transport,

I, Bruce Hamilton Currie, Senior Vehicle Engineer, hereby approve the computer software specified in Schedule 1 of this notice for the purpose of demonstrating compliance with the requirements in Schedule 5 of the Rule subject to the condition in Schedule 2.

Schedule 1: The software to be approved

Title: “NZ BRAKE CODE SOFTWARE”

Version: VERSION 5.3 of 25/2/94

Schedule 2: The conditions of the approval

The software is only approved for the period 1 October 2008 to 30 June 2009 (inclusive).

Those powers under section 35 of the Submarine Cables and Pipelines Protection Act 1996 to the Director of Maritime New Zealand by an instrument of delegation dated 17 January 2008.

Therefore I, Trevor Coad, Acting Director of Maritime New Zealand, hereby approve the following equipment to be approved maritime surveillance equipment for the purposes of the Submarine Cables and Pipelines Protection Act 1996.

Approved Maritime Surveillance Equipment

  • Panasonic Lumix DMC-FZ18 digital camera, Serial # CP7651047
  • Olympus μ795SW digital camera, Serial # E40515441
  • Panasonic Lumix DMC-FZ20 digital camera, Serial # K4SF01587

when operated on a Cook Strait CPZ patrol vessel or patrol helicopter working in or near the protected area designated “Area 7 – Cook Strait” and while working under any instructions given in writing by Transpower New Zealand Limited.

That part of the notice of Approved Maritime Surveillance Equipment appearing in the New Zealand Gazette, 10 March 2005, No. 48, page 1265, relating to the above Panasonic Lumix DMC-FZ20 digital camera, Serial # K4SF01587, is revoked.

This notice comes into effect on 13 November 2008.

Declaration Under the Submarine Cables and Pipelines Protection Act 1996

Whereas, pursuant to section 441 of the Maritime Transport Act 1994, the Minister of Transport did delegate those powers under section 12(6) of the Submarine Cables and Pipelines Protection Act 1996 to Maritime New Zealand by an instrument of delegation dated 19 March 1997.

And whereas, pursuant to section 442 of the Maritime Transport Act 1994, and section 73 of the Crown Entities Act 2004, Maritime New Zealand did delegate those powers under section 12(6) of the Submarine Cables and Pipelines Protection Act 1996 to the Director of Maritime New Zealand by an instrument of delegation dated 17 January 2008.

Therefore I, Trevor Coad, Acting Director of Maritime New Zealand, hereby make the following declaration:

Declaration

The Submarine Cables and Pipelines Protection Order 1992 shall not apply in respect of the following ships:

Brandywine

Seawind

in respect of the protected area designated “Area 7 – Cook Strait” when those vessels are anchored or moored in Oteranga Bay at locations approved by Transpower New Zealand Limited and are being operated in connection with the Meridian Energy Limited wind farm construction project “West Wind.”
