Environmental Risk Management Authority

Hazardous Substances and New Organisms Act 1996

Notice of Intention to Apply for Approval of Code of Practice

Pursuant to section 79 of the Hazardous Substances and New Organisms Act 1996, the Environmental Risk Management Authority gives notice that Hazknow Limited intends to apply for the approval of the Code of Practice for the Transfer and Transport of Class 1 Explosives.

This code specifies requirements for the Transport of Class 1 Explosives by Road and Rail and requirements for the Transfer of Class 1 Explosives from one mode of transport to another, ie ship to truck, truck to rail.

This code is a means of compliance with Regulations 46 through to 52A inclusive of the Hazardous Substances (Classes 1 to 5 Controls) Regulations.

These Regulations provide controls for the storage and handling of explosives and this code of practice provides a practical means of meeting these controls.

Written submissions in relation to the approval of this code can be made by mail, facsimile or email to the contacts below.

Submissions close on 28 November 2008.

Pursuant to section 38 of the Securities Markets Act 1988, the Securities Commission gives the following notice.

Clause 1: Title, commencement, and expiry—(1) This notice is the Authorised Futures Dealers (JPMorgan Chase Bank, N.A., and J.P. Morgan Australia Limited) Notice 2008.

(2) This notice comes into force on the day after the date of its publication in the New Zealand Gazette.

(3) This notice expires on the close of 31 October 2013.

Clause 2: Interpretation—(1) In this notice, unless the context otherwise requires:

“Act” means the Securities Markets Act 1988.

“AFS License” means an Australian Financial Services License granted under the Corporations Act.
