  1. Cancellation of appointments—On 11 October 2008, the Associate Minister of Fisheries (acting pursuant to a delegated authority) cancelled, under Regulation 10(1) of the Fisheries (Kaimoana Customary Fishing) Regulations 1998, the appointment of Pet Gardiner as a Tangata Kaitiaki for managing customary food-gathering within the area/rohe moana.

  2. Nomination of Tangata Kaitiaki—The Tauranga Moana Iwi Customary Fisheries Working Committee, on behalf of Ngāiterangi, Ngāti Ranginui and Ngāti Pukenga, has nominated Desmond Gardiner as a replacement Tangata Kaitiaki and John Rolleston Jnr as an additional Tangata Kaitiaki for managing customary food-gathering within the area/rohe moana.

  3. Appointment of Tangata Kaitiaki—On 11 October 2008, the Associate Minister of Fisheries (acting pursuant to a delegated authority) confirmed, under Regulation 10(2) of the Fisheries (Kaimoana Customary Fishing) Regulations 1998, the appointment of Desmond Gardiner as a replacement Tangata Kaitiaki and, under Regulation 9(1) of the Fisheries (Kaimoana Customary Fishing) Regulations 1998, the appointment of John Rolleston Jnr as an additional Tangata Kaitiaki for managing customary food-gathering within the area/rohe moana.

  4. Power to authorise the taking of fisheries resources for customary food-gathering—A Tangata Kaitiaki may authorise any individual to take fisheries resources managed under the Fisheries Act 1996, other than those resources that are taken in fresh water, for customary food-gathering purposes from within the whole or any part of the area/rohe moana. No customary food-gathering of fisheries resources may take place in the area/rohe moana without an authorisation from a Tangata Kaitiaki.

Fisheries (South Island Customary Fishing) Regulations 1999

Fisheries (South Island Customary Fishing) Notice (No. 17) 2008 (No. F470)

Pursuant to Regulation 9 of the Fisheries (South Island Customary Fishing) Regulations 1999, the Programme Manager (Deed of Settlement Implementation Programme) at the Ministry of Fisheries (acting pursuant to a delegated authority in accordance with section 41 of the State Sector Act 1988) gives the following notice.

Notice

  1. Title and commencement—(1) This notice may be cited as the Fisheries (South Island Customary Fishing) Notice (No. 15) 2008.

(2) This notice shall come into effect the day after the date of its notification in the New Zealand Gazette.

  1. Interpretation—In this notice:

(a) “customary food-gathering” has the same meaning as defined in the Fisheries (South Island Customary Fishing) Regulations 1999.

(b) “Tangata Tiaki/Kaitiaki” means the person or persons appointed under Regulation 9 of the Fisheries (South Island Customary Fishing) Regulations 1999 for the management of customary food-gathering within an area/rohe moana.

(c) “area/rohe moana” means an area from Waihemo to Purehurehure, extending seaward to the limit of the South Island fisheries waters as defined under Regulation 2 of the Fisheries (South Island Customary Fishing) Regulations 1999, being the 200-mile limit, and inland to boundaries defined for Kāti Huirapa ki Puketeraki under Te Runanga o Ngai Tahu Act 1996.

  1. Nomination of Tangata Tiaki/Kaitiaki—Kāti Huirapa Rūnaka ki Puketeraki, being representative of tangata whenua holding manawhenua manamoana over the area/rohe moana (as represented by Te Rūnanga o Ngāi Tahu), has nominated Rua Hagan as a Tangata Tiaki/Kaitiaki to manage customary food-gathering in the area/rohe moana for a further five-year term.

  2. Appointment of Tangata Tiaki/Kaitiaki—On 11 October 2008, the Associate Minister of Fisheries (acting pursuant to a delegated authority) confirmed, under Regulation 9(1) of the Fisheries (South Island Customary Fishing) Regulations 1999, the reappointment of Rua Hagan as a Tangata Tiaki/Kaitiaki to manage customary food-gathering in the area/rohe moana. The appointment is a five-year term commencing the day this notice comes into effect.

  3. Power to authorise taking of fisheries resources for customary food gathering—Tangata Tiaki/Kaitiaki may authorise any individual to take fisheries resources managed under the Fisheries Act 1996 for customary food-gathering purposes from within the whole or any part of the area/rohe moana for which they have been appointed as a Tangata Tiaki/Kaitiaki. No customary food-gathering of fisheries resources may take place in the area/rohe moana without an authorisation from a Tangata Tiaki/Kaitiaki.

In the notice with the above heading, dated the 14th day of October 2008 and published in the New Zealand Gazette, 16 October 2008, No. 159, page 4180, in clauses 4 and 5, please replace

“Charles Louie Solomon Rehu”

with

“Charles Louie Solomon Rehe”

and in clause 6, please delete the words “and the mātaitai reserve”.
