Notice of Application for Approval of a Scheme

Pursuant to Part III of the Charitable Trusts Act 1957

Notice is given that the board of trustees of the Marsden Cross Trust Board (“board”), a charitable trust created by Deed of Trust dated the 25th day of August 2003 and amended on 13 September 2006 (“trust deed”), has applied to the High Court at Auckland under the Charitable Trusts Act 1957 for approval of a scheme, whereby the trust deed is varied as follows:

(a) By establishing the Marsden Cross Church Advisory Board (“advisory board”), the members of which shall be appointed by the church bodies in the same manner as they are currently appointed;

(b) By setting out the functions of the advisory board as:

(i) maintaining the vision set out in the trust deed;

(ii) advising and assisting the board; and

(iii) appointing four members of the advisory board as members of the board;

(c) By constituting as the first advisory board, the church representatives on the board holding office prior to the special general meeting of the board held on 31 October 2007; and

(d) By altering the composition of the board to four members appointed by the advisory board and six members appointed by the board, being the three non-church appointed board members holding office prior to the special general meeting of the board held on 31 October 2007 and three further members to be appointed by the board (such that the board is no longer required to maintain an ecumenical balance).

The application is to be heard before the High Court at Auckland on Monday, 17 November 2008 at 10.00am.

Any person wishing to oppose the scheme must give written notice of his or her intention to do so not less than seven days prior to the hearing to the Registrar of the High Court at Auckland, the trustees of the board c/o Russell McVeagh, 48 Shortland Street, Auckland (Attention: S. A. Armstrong), and the Attorney General c/o the Crown Law Office.
