Rules.

The Commission recommended that the new section be entitled Hedge Arrangement Disclosure Rules.

In addition, the Commission made recommendations for consequential amendments to Part A of the Rules.

The recommended amendments to the Rules require:

(a) participants (as defined in the Rules) to disclose risk management contract details (captured by specific criteria) to the information system; and

(b) the information system to make the information publicly available.

Electricity (Levy of Industry Participants) Regulations 2005

Notice of Adjusted Annual Levy Rates for the Financial Year Ending 30 June 2009

The Electricity Commission (“Commission”) has adjusted the annual levy rates for the financial year ending 30 June 2009, in accordance with Regulation 10(1)(a) of the Electricity (Levy of Industry Participants) Regulations 2005 (“Regulations”).

The adjustment reduces the supply security operations portion of the levy to remove any impact in 2008/09 from the $40 million provision for reserve energy emergency measures, which was included in the calculation of the annual levy rates dated the 14th day of July 2008 and published in the New Zealand Gazette, 17 July 2008, No. 114, page 3032.

This notice of adjusted annual levy rates is issued in accordance with Regulation 8 of the Regulations. The Commission has recalculated the annual levy rates in accordance with Regulation 7.

The adjusted levy rates, which apply from the monthly instalment payable in October 2008 in respect of September 2008, are as follows:
