Reassessment of Anti-dumping Duty: Galvanised Wire From South Africa
Pursuant to section 14 of the Dumping and Countervailing Duties Act 1988 ("the Act"), the Minister of Commerce, having carried out a reassessment of the anti-dumping duty applying to imports into New Zealand of galvanised wire from South Africa and having determined a new rate of anti-dumping duty applicable to those goods, gives the following notice.

Notice
Title and commencement—(1) This notice may be cited as the “Reassessment of Anti-dumping Duty: Galvanised Wire From South Africa”.
(2) This notice replaces and supersedes all previous notices in relation to the subject goods described below in the First Schedule.
(3) Pursuant to section 17 of the Act, the reassessed anti-dumping duty, set out in the Second Schedule to this notice, shall apply to imports of the goods specified in the First Schedule with effect from the day after the date of this notice.
(4) Where the anti-dumping duties imposed as a result of this notice are lower than those previously in place, in accordance with subsection 14(10) of the Act, importers may apply to Customs for a refund of the difference between the anti-dumping duties imposed by this notice and the anti-dumping duty paid from 18 December 2007.
Schedules
First Schedule
Subject Goods
The subject goods that the reassessed anti-dumping duty rate applies to are described as:
"Galvanised steel wire of high, medium and low tensile strength between 2mm and 4.5mm in diameter,
but EXCLUDING the following:
Galvanised steel spring wire AS1472 exceeding 4mm in diameter."
The goods are currently classified under Tariff Item 7217.20.10 and Statistical Keys 05L, 07G, 08E, 09C, 11E, 13A, 15H, 16F, 17D, 18B, 25E, 27A, 28K, 29H, 31K, 33F, 35B, 36L, 37J and 39E, and Tariff Item 7217.20.90 and Statistical Keys 05D, 07L, 08J, 09G, 11J, 13E, 15A, 16K, 17H and 18F of the Tariff of New Zealand, which classification is provided for convenience and Customs purposes only, the written description being dispositive.
Second Schedule
Amount of Anti-dumping Duty
The amount of anti-dumping duty to be paid on demand in respect of each importation of the subject goods imported, or intended to be imported, into New Zealand
from South Africa, shall be an ad valorem percentage rate of 33 percent.
The ad valorem percentage rate will apply to all imports of the subject goods from South Africa on the basis of the value for duty (VFD) of the subject goods when imported into New Zealand except those supplied by African Gabions (Pty) Limited and Finmesa Investment Corporation.
Anti-dumping Duties: Notice That Anti-dumping Duties on Reinforcing Steel Bar and Coil From Thailand May Cease to Apply
Under section 14(9) of the Dumping and Countervailing Duties Act 1988 ("the Act"), anti-dumping duties imposed on reinforcing steel bar and coil from Thailand* will cease to apply to those goods on 5 March 2009 unless, at that date, the goods are subject to review under section 14(8) of the Act.
Any interested party that might request that the Chief Executive of the Ministry of Economic Development initiate a review before the cessation date referred to above, should be aware that positive evidence justifying the need for a review must be provided to the chief executive.
If an application is received which provides positive evidence justifying the need for a review, the chief executive must undertake and complete a review investigation within 180 days of initiation, on whether the anti-dumping duties should continue to be applied.
Positive evidence justifying the need for a review would need to include reasons for believing that the expiration of anti-dumping duties would see the continuation or recurrence of dumping of reinforcing steel bar and coil from Thailand, and for believing that such dumping would be likely to cause the continuation or recurrence of material injury to the New Zealand industry producing reinforcing steel bar and coil.
The reasons should be supported by evidence and not be based on mere allegations or assertions.
