The Companies Act 1993

On 8 July 2008, it was resolved by special resolution, pursuant to section 241(2)(a) of the Companies Act 1993, that the company be liquidated and that Kim S. Thompson, insolvency practitioner of Hamilton, be appointed liquidator.

The liquidation commenced on 8 July 2008.

Notice to Creditors to Claim

Notice is also given that the liquidator hereby fixes 18 August 2008, as the day on or before which the creditors of the company are to prove their debts or claims and to establish any title that they may have to priority, under section 304 of the Companies Act 1993, or to be excluded from the benefit of any distribution made before the debts are proved or, as the case may be, from objecting to the distribution.

David Ross Petterson, forensic accountant of Levin, was appointed liquidator of Wescott Holdings Limited, pursuant to section 241(2)(a) of the Companies Act 1993, on 2 July 2008 at 4.00pm.

Notice of Meeting of Creditors

The liquidator does not consider that a meeting of creditors should be held as the indicative liabilities of the company materially exceed the value of its assets such that a distribution to unsecured creditors is unlikely.

In the event that this position changes, the liquidator will advise, in writing, of the changed position to all creditors at the address advised at the time of lodging their claim.

Accordingly, no such meeting will be called unless a creditor gives notice in writing to the liquidator within 10 working days after the publication of this notice, requiring a meeting to be called.
