Notification of Receipt of Standard Terms Proposal From Telecom for Subloop Services Under the Telecommunications Act 2001

Pursuant to section 30I of the Telecommunications Act 2001 (the “Act”), the Commerce Commission (the “Commission”) gives public notice that it has received a standard terms proposal from Telecom Corporation of New Zealand Limited for the designated services described in Subpart 1, Part 2 of Schedule 1 of the Act as:

(a) “Telecom’s unbundled copper local loop network” as it relates to the connection of subloops between and end user’s building (or building distribution frame) to the handover point in a distribution cabinet (or equivalent facility);

(b) “Telecom’s unbundled local loop network co-location” as it relates to the provision of co-location facilities for an access seeker’s equipment, and access to the handover point at Telecom’s distribution cabinet (or equivalent facility) for purposes of providing access to, and interconnection with, Telecom’s unbundled copper local loop network (including any necessary supporting equipment); and

(c) “Telecom’s unbundled copper local loop network backhaul” (distribution cabinet to telephone exchange).

Parties to the determination have until 5.00pm on 18 July 2008 to submit on the proposal.

Submissions may be made about any matter to which the proposal relates but must set out the wording of any additional or alternative terms that are proposed to be included in the standard terms determination.

Electricity Governance Regulations 2003

Electricity Governance Regulations (Exemption No. 79 (Energy Online Limited)) Exemption Amendment Notice 2008

Pursuant to Regulation 194(5)(d) of the Electricity Governance Regulations 2003 (“Regulations”) the Electricity Commission gives the following notice.

Notice

1. Title and commencement—(1) This notice is the Electricity Governance Regulations (Exemption No. 79 (Energy Online Limited)) Exemption Amendment Notice 2008.

(2) In this notice, the Electricity Governance Regulations (Exemption No. 79 (Energy Online Limited)) Exemption Notice 2008* is called the “principal notice”.

(3) This notice comes into force on the day after the date in which it is notified in the New Zealand Gazette.

2. Amendment to principal notice—(1) The principal notice was granted under urgency in reliance on Regulation 194(4) of the Regulations and provides an exemption from the requirement to comply with Rule 2.4.3 of Part H of the Electricity Governance Rules 2003 (“Rules”).

(2) The principal notice is amended by omitting clause 5(2) and substituting:

“(2) This exemption expires at the close of 28 February 2009.”

3. Reason for amendment—The reason for this amendment is to allow sufficient time for the review of relevant rules within Part H of the Rules.
