Revocation of a Notice Relating to Land Taken for Road and a Local Purpose Reserve and Issue of a Fresh Notice

Pursuant to section 55 of the Public Works Act 1981, and by reason of an error made in the notice described subsequently, the Minister for Land Information revokes the notice headed “Declaring Land to be Taken for Road and a Local Purpose Reserve and the Grant of an Easement Over Land in the City of Christchurch—Burwood Primary School, New Brighton Road, Christchurch” dated the 2nd day of May 2008 and published in the New Zealand Gazette, 15 May 2008, No. 84, page 2294, and issues the following notice as a fresh notice in its place.

Land to be Set Apart for Road and a Local Purpose Reserve and the Grant of an Easement Over Land—Burwood Primary School, New Brighton Road, Christchurch City

Pursuant to the Public Works Act 1981, and to a delegation from the Minister for Land Information, Trevor Knowles, Land Information New Zealand:

(a) Pursuant to section 114(1), declares the land described in the First Schedule to this notice to be set apart as road and vested in the Christchurch City Council;

(b) Pursuant to section 50(1), further declares the land described in the Second Schedule to this notice to be set apart as a local purpose (war memorial) reserve, subject to the Reserves Act 1977, and to be vested in the Christchurch City Council; and

(c) Pursuant to section 28, further declares that the land described in the Second Schedule to this notice that is subject to the creation of an easement for the right to convey electric power on the terms and conditions as set out in Schedule 4 to the Land Transfer Regulations 2002 over the area marked “A” on SO 404380 in favour of, and to be held appurtenant to, part RS 40299, being the balance of the land in Gazette Notice 911182 on the date of publication of this notice in the New Zealand Gazette.

Road Realignment—State Highway 3, Rapanui Road, Wanganui District

Pursuant to the Public Works Act 1981, and to a delegation from the Minister for Land Information, R. J. Sutherland, Land Information New Zealand:

(a) Pursuant to sections 116 and 117(3)(b), declares the portions of road adjoining or passing through the land described in the First Schedule to this notice to be stopped, and, pursuant to section 120(3), amalgamated with the land in Computer Freehold Register WN131/45, subject to Gazette Notice 797302, Part IVA of the Conservation Act 1987 and section 11 of the Crown Minerals Act 1991;

(b) Pursuant to sections 117(3)(b) and 120(3), declares the portion of stopped Government road described in the Second Schedule to this notice to be amalgamated with the land in Computer Freehold Register WN131/45, subject to Gazette Notice 797302, Part IVA of the Conservation Act 1987 and section 11 of the Crown Minerals Act 1991;

(c) Pursuant to sections 117(3)(b) and 120(3), declares the portions of severance described in the Third Schedule to this notice to be amalgamated with the land in Computer Freehold Register WN131/45, subject to Gazette Notice 797302, Part IVA of the Conservation Act 1987 and section 11 of the Crown Minerals Act 1991 on the date of publication of this notice in the New Zealand Gazette.

Land Declared Road—State Highway 14, Tangowahine Valley Road, Kaipara District

Pursuant to section 114 of the Public Works Act 1981, and to a delegation from the Minister for Land Information, Stephen Robert Gilbert, Land Information New Zealand, declares the land described in the Schedule of this notice to be declared road which, pursuant to section 60(2) of the Transit New Zealand Act 1989, forms part of State Highway 14 and shall vest in the Crown on the date of publication of this notice in the New Zealand Gazette.
