Burial and Cremation Act 1964

Closure of the Mount Magdala Burial Ground (known as Mount Magdala Cemetery), Christchurch

I, Graeme Richard Gillespie, Group Manager, Population Health Protection Group, acting under delegation from the Minister of Health, make the following directions under the Burial and Cremation Act 1964 ("the Act"):

  1. Under section 41(1) of the Act, the denominational burial ground known as the Mount Magdala Burial Ground, Christchurch, being part of the land described in the Schedule to this notice ("the burial ground"), shall be closed, subject to the qualification set out in paragraph 2 below, and burials there shall be discontinued from and including 19 December 2008 ("the date of closure").

  2. This closing order shall be subject to the following qualification:

  • Under the proviso to section 43(1) of the Act, the control and management of the closed burial ground comprising 2958 square metres, more or less, and marked "A" on the attached plan, shall be vested in the Christchurch City Council from the date of closure.

  • Under the proviso to section 44(4) of the Act, section 44(4) shall not apply to that part of the burial ground comprising 363 square metres, more or less, and marked "B" on the plan and indicated by diagonal lines, which has never been used for burials, and such land is to be diverted for the purpose of amalgamation with, and form part of Computer Freehold Register CB8F/944, from the date of closure.
