Electricity Act 1992

Notice of Making of Electricity Governance Amendment Rules (No. 55) 2007 and Notice of Reasons for Decision

  1. Pursuant to section 172I of the Electricity Act 1992 ("Act"), I notify the amendment of the Electricity Governance Rules 2003 ("Rules") under section 172H of the Act.

  2. The empowering provision for the Electricity Governance Regulations in relation to which the amendments to the Rules are made is section 172D(1)(1)(b) of the Act.

  3. The nature of the amendment of Rule 11.5.3 of Section IV of Part C is to change the wording of the Rule to correct the definition of the receivers of under-frequency event rebates and to delete a superfluous extension of this definition to a special case of receivers.

  4. Pursuant to section 172Z(4) of the Act, the reasons for my decision to amend the Rules are that the changes correct existing anomalies, align with current practice and cause the least disruption to related rules.

  5. These Rules come into force on 27 September 2007.

  6. Copies of the Rules may be inspected free of charge or purchased from the Electricity Commission, Level 7, ASB Bank Tower, 2 Hunter Street, Wellington. The Rules can also be viewed on the Electricity Commission’s website:

Electricity Governance Regulations 2003

Electricity Governance Regulations (Exemption No. 45 (Transpower New Zealand Limited)) Exemption Notice 2007

Pursuant to Regulation 194(2) of the Electricity Governance Regulations 2003, the Electricity Commission ("Commission") gives the following notice.

Notice

  1. Title and commencement—(1) This notice is the Electricity Governance Regulations (Exemption No. 45 (Transpower New Zealand Limited)) Exemption Notice 2007.

(2) This notice comes into force on the day after the date it is notified in the New Zealand Gazette.

  1. Exemption—Transpower New Zealand Limited ("Transpower") is exempted from compliance with Rule 3.1.3.2(b) of Section II of Part F of the Electricity Governance Rules 2003 ("Rules").

  2. Terms and conditions—This exemption is granted on the condition that it expires on 26 October 2007.

  3. Reasons for granting the exemption—The reasons for granting this exemption are:

(a) Transpower is not currently able to comply with some of the requirements of Section II of Part F of the Rules as they relate to determining the content of the schedules of draft default transmission agreements;

(b) the Commission is consulting on proposed rule changes to address this issue. These rule changes, if made by the Minister of Energy, are likely to come into effect by 25 October 2007;

(c) the exemption will allow time for the Commission to consult on the proposed rule changes and (depending on the results of the consultation) recommend them to the Minister.
