Reappointment to Auckland Regional Holdings
By resolution of the Auckland Regional Council at its
meeting held on 25 June 2007, and pursuant to section 24 of
the Local Government (Auckland) Amendment Act 2004, the
council reappointed
Judith Bassett
as chair of Auckland Regional Holdings for a further term of
three years commencing 1 July 2007.

Electricity Act 1992
Notice of Making of Electricity Governance Amendment Rules (No. 56) 2007 and Notice of Reasons for Decision

Pursuant to section 172I of the Electricity Act 1992
(“Act”), I notify the amendment of the Electricity Governance
Rules 2003 (“Rules”) under section 172H of the Act. -
The empowering provision for the electricity governance
regulations in relation to which the amendment to the Rules
is made is section 172D of the Act. -
A brief description of the nature of the amendment is
to add an effective date for the Transmission Pricing
Methodology (“TPM”) contained in Schedule F5 of Section
IV of Part F of the Rules. -
Pursuant to section 172Z(4) of the Act, the reasons for
my decision to amend the Rules are that:
(a) Rule 8.4 of Section IV of Part F of the
Rules requires the Electricity Commission
(“Commission”) to make a recommendation to
me about the adoption of a TPM, including a date
that the TPM must take effect;
(b) the Commission has consulted extensively on the
TPM, including specifically on the date from
which the TPM must take effect; and
(c) I agree that 1 April 2008 is the most appropriate date
for the TPM to take effect.

These Rules come into force on 13 September 2007.

Notice of Making of a Recommendation and Assessment Concerning the Electricity Governance Rules 2003 – Rule Amendment Proposal No. 104, 2007

This notice of a recommendation and assessment
concerning the Electricity Governance Rules 2003 (“Rules”),
Rule Amendment Proposal No. 104, is issued by the
Electricity Commission (“Commission”), pursuant to
section 172E(2)(c) of the Electricity Act 1992 (“Act”). -
Section 172E(2)(c) of the Act provides that, no later than
10 working days after making a recommendation concerning
the Rules to the Minister of Energy, the Commission must
publicise the recommendation and the assessment completed
under section 172F of the Act.
Recommendation
- On 10 August 2007, the Commission made a
recommendation that Rule 11.5.3 of Section IV of Part
C of the Rules be amended.
Recommended Amendment to the Rules
- The key differences between the existing Rule 11.5.3 of
Section IV of Part C and the one recommended by the
Commission are:
(a) replacing the requirement to rebate event charges
to availability cost “payees” with a requirement to
effectively rebate such charges to “payers” of
availability cost in accordance with the original
intention of the rule; and
(b) omitting the requirement to rebate availability cost
to a special category (causers holding a dispensation
including a rebate entitlement), because there is no
mention in the Rules about the methodology of
allocating payments, and hence no participants fall
in this category.
