Notice of Intention to Take Land for Road—Part Allotment 122, Parish of Pakuranga

Notice is hereby given that the Manukau City Council (“the council”), under the provisions of section 23 of the Public Works Act 1981, proposes to take land described in the Schedule hereto (“the land”).

The land is required for roading purposes. The intended taking is considered reasonably necessary for:

● providing a north-south collector roading link between Ormiston Road and Flatbush School Road;
● improving traffic management of the Flat Bush town centre;
● improving traffic efficiency and safety; and
● upgrading landscapes and streetscapes.

The above-mentioned roading link is consistent with council’s Flatbush Structure Plan which has the following five principal objectives:

(a) to provide sustainable, efficient and optimal utilisation and urban development of land;
(b) to provide a framework of land subdivision to facilitate its development in accordance with sound principles of urban design;
(c) to provide a guide for the location of future roading patterns;
(d) to provide information relating to the location and alignments of proposed roading networks, roading functions and hierarchies, and areas of land required by roads, together with associated utility services generally within the road corridors; and
(e) to provide subdivision of land that may be carried out in the most space efficient manner to provide attractive and sustainable urban and residential environments.

The land is currently constricting development in a west/east direction.

The council considers there are no other suitable or better alternative sites, routes or other methods of achieving the above objectives and the acquisition of the land for road is considered reasonably necessary.

The owners of the land and those persons with a registered interest in it have been served with notice of the council’s intention to take the land and advised of their right to object.

Any other person having the right to object may send a written objection to the Registrar, Environment Court, Tribunals Division, Ministry of Justice, PO Box 5027, Wellington, within 20 working days after the date of publication of this notice.

If any objection is made in accordance with this notice, a public hearing will be held.

The objector will have a right to appear and be heard personally, unless the objector otherwise requires.

Each objector will be informed of the time and place of the hearing.
