Pursuant to section 52(1) of the Public Works Act 1981, and to a delegation from the Minister for Land Information, Stephen Robert Gilbert, Land Information New Zealand, declares the land described in the Schedule to this notice to be set apart for use in connection with a road (segregation strip) and shall remain vested in the Crown.

Restriction on Creating an Obstruction Impeding Sight Visibility—State Highway 1, Piano Hill, Whangarei District

Pursuant to section 236 of the Public Works Act 1981, and to a delegation from the Minister for Land Information, Stephen Robert Gilbert, Land Information New Zealand, declares the land described in the Schedule to be subject to the following restriction:

The owner or occupier of the land described in the Schedule shall (unless the prior written consent of the Crown is obtained, and then only in accordance with such terms and conditions as the Crown may impose in respect of such consent):

(a) Be prohibited from planting or causing or allowing to be planted any trees or shrubs that may grow to a height of more than 20 centimetres above the existing ground level and from erecting or placing thereon any buildings, concrete work or other erections or fences at any time from the date of this notice.

(b) Not at any time do, permit, or suffer to be done any act whereby the restriction set out in this notice may be interfered with or affected in any way.

(c) Ensure that all third parties permitted by it to enter into the subject land from time to time do so subject to and at all times in compliance with the restrictions set out in this notice.

Pursuant to section 20 of the Public Works Act 1981, and to a delegation from the Minister for Land Information, Stephen Robert Gilbert, Land Information New Zealand, declares that, an agreement to that effect having been entered into:

(a) The land described in the First Schedule to this notice is hereby acquired for road diversion and shall vest in the Christchurch City Council;

(b) The land described in the Second Schedule to this notice is hereby acquired for use in connection with a road (segregation strip) and shall vest in the Crown on the date of publication of this notice in the New Zealand Gazette.
