In the notice with the above heading, dated the 2nd day of March 2001 and published in the New Zealand Gazette, 8 March 2001, No. 25, page 575, in clauses 3 and 4 please replace:

Fisheries (Kaimoana Customary Fishing) Notice (No. 5) 2007 (No. F404)

Pursuant to Regulations 9 and 10 of the Fisheries (Kaimoana Customary Fishing) Regulations 1998, the Programme Manager (Deed of Settlement Implementation Programme) at the Ministry of Fisheries (acting pursuant to a delegated authority in accordance with section 41 of the State Sector Act 1998) gives the following notice.

Notice

  1. Title and commencement—(1) This notice may be cited as the Fisheries (Kaimoana Customary Fishing) Notice (No. 5) 2007.

(2) This notice shall come into effect the day after the date of its notification in the New Zealand Gazette.

  1. Interpretation—In this notice:

(a) “customary food-gathering” has the same meaning as defined in Regulation 2 of the Fisheries (Kaimoana Customary Fishing) Regulations 1998.

(b) “Kaitiaki” is a local dialect word that has the same meaning as “Tangata Kaitiaki/Tiaki”, a term that is defined in Regulation 2 of the Fisheries (Kaimoana Customary Fishing) Regulations 1998;

(c) “Kaitiaki” means the person or persons appointed under Regulation 9 or 10 of the Fisheries (Kaimoana Customary Fishing) Regulations 1998 for the management of customary food-gathering within the area/rohe moana;

(d) “area/rohe moana” means all those waters enclosed in an area described by a line beginning on the coastline at Waipuna Stream (37°56.1′S, 177°31.4′E) and travelling north to an ocean point (37°54.8′S, 177°31.4′E) then west-south-west to an ocean point (34°54.6′S, 177°25.9′E), then south to the beach at Te Toka a Rutaia Tarakeha (37°58.4′S, 177°25.9′E)

and then east-north-east along the mean high-water springs mark to the point of commencement. The geographical coordinates named are in terms of the WGS84 datum.

  1. Request to cancel appointment—Ngāitai Iwi, through the Ngāitai Iwi Authority, being the tangata whenua who nominated Russell Mio and the late Selwyn Lawson as Kaitiaki for the area/rohe moana, requested in writing the cancellation of the appointment of Russell Mio and the late Selwyn Lawson as Kaitiaki.

  2. Cancellation of appointment—On 26 April 2007, the Associate Minister of Fisheries confirmed the cancellation of the appointment of Russell Mio and the late Selwyn Lawson as Kaitiaki for managing customary food-gathering within the area/rohe moana.

  3. Nomination of Kaitiaki—Ngāitai Iwi, through the Ngāitai Iwi Authority, nominated Joshua Kauta and Wency Rewi as replacement Kaitiaki and Geoffrey Burton, Moana Flowers, Tuiringa Mokomoko, Hoturoa Richmond, Kevin Richmond and Mac Watson as additional Kaitiaki for managing customary food-gathering within the area/rohe moana.

  4. Appointment of Kaitiaki—On 26 April 2007, the Associate Minister of Fisheries confirmed the appointment of Joshua Kauta and Wency Rewi as replacement Kaitiaki and Geoffrey Burton, Moana Flowers, Tuiringa Mokomoko, Hoturoa Richmond, Kevin Richmond and Mac Watson as additional Kaitiaki for managing customary food-gathering within the area/rohe moana.

  5. Power to authorise the taking of fisheries resources for customary food-gathering—A Kaitiaki may authorise any individual to take fisheries resources managed under the Fisheries Act 1996, other than those resources that are taken in fresh water, for customary food-gathering purposes from within the whole or any part of the area/rohe moana. No customary food-gathering of fisheries resources may take place in the area/rohe moana without an authorisation from a Kaitiaki.

Designation of Sanctioned Entities (Iran Sanctions)

On 23 December 2006, the individuals and organisations listed below were designated as being engaged in, or directly associated with, or providing support for, Iran’s proliferation sensitive nuclear activities or the development of nuclear weapon delivery systems pursuant to United Nations Security Council Resolution 1737 (2006).

On 19 March 2007, New Zealand passed the United Nations Sanctions (Iran) Regulations which implemented an asset freeze against these individuals and organisations.

  2. Mesbah Energy Company (provider for A40 research reactor — Arak)
