Advertisement of Application for Putting Company into Liquidation by the Court

Take notice that on 11 August 2006, an application for putting into liquidation Total Taxation & Accounting Services Limited by the High Court was filed in the High Court at Tauranga.

The application is to be heard before the High Court at Rotorua on Friday, 13 April 2007 at 11.00am.
Any person, other than the defendant company, who wishes to appear on the hearing of the application must file an appearance not later than the second working day before that day.

The plaintiff is the Commissioner of Inland Revenue, whose address for service is offices of the Inland Revenue Department, 1 Bryce Street, Hamilton.

Corrigendum—Notice of Intention to Restore Company to the Register

Companies Act 1955

The following company was reinstated to the Register of Companies on 26 March 2007:

Taranaki Mortgage Investments Limited (in liquidation). 172124.

It had been removed on the incorrect grounds that no liquidator was acting and then restored under section 328 of the Companies Act 1993 that did not apply to it, as the liquidation had commenced under the Companies Act 1955 on 13 September 1989.

The procedures for removal and restoration were null and void (refer Re Crott’s Application (1991) 5 NZCLC 67,325) and it is proper that the Register be corrected.
