Officer of the Government of Ross Dependency Appointed

ANAND SATYANAND, Governor-General

Background:

A. An Order in Council dated 30 July 1923* (“the order”) made under the British Settlements Act 1887 (UK) appoints the Governor-General of New Zealand to be the Governor of the Ross Dependency (“the Governor”) and vests in the Governor certain powers:

B. The order empowers the Governor to make rules, order, and good government of the Dependency:

C. Regulations made by the Governor on 14 November 1923† provide that all persons appointed by the Governor may be empowered to do such things as may be necessary or desirable to ensure that the laws in force in the Dependency are duly observed and complied with in every respect, and to do all things necessary or expedient for the peace, order, and good government of the Dependency, and to safeguard and preserve Her Majesty’s rights and sovereignty over and in respect of the Dependency:

D. It is now expedient that Glenn Stephen Powell be appointed an officer of the Government of the Dependency:

Now therefore I, The Honourable Anand Satyanand, the Governor-General of New Zealand, and as such the Governor of the Dependency, appoint

Glenn Stephen Powell

to be an officer of the Government of the Dependency while he acts as Senior New Zealand Representative at Scott Base during the period beginning with this appointment and ending with the close of 15 October 2007:

I confer on Glenn Stephen Powell, while he holds office as an officer of the Government of the Dependency, all the powers exercisable in New Zealand by a Justice of the Peace, and also the powers exercisable in New Zealand by a Coroner:

Glenn Stephen Powell is to exercise his functions at such places within the Dependency as may be directed by an officer of the Government of the Dependency who has the general executive and administrative authority in preserving Her Majesty’s rights and sovereignty and the laws in force in the Dependency.

As witness the hand of His Excellency the Governor-General as the Governor of the Ross Dependency, this 9th day of March 2007.

Telecommunications Act 2001

Notification of Approval of an Exemption for Telecom New Zealand Limited to Clause 14.2.1 of the Number Portability Network Terms for Post Dial Delay for the Two Call Scenarios Specified in Telecom’s Application for Exemption for the Period Between 1 April 2007 and 31 December 2012

On 12 February 2007, the Commerce Commission, pursuant to section 15 of the Network Terms for Local and Mobile Number Portability in New Zealand (“Network Terms”), approved an exemption to clause 14.2.1 of the Network Terms for Telecom New Zealand Limited (“Telecom”).

The Network Terms are part of Commission Decision 554 on the multi-party application for determination of “local telephone number portability service” and “cellular telephone number portability service” designated multinetwork services, dated 31 August 2005, pursuant to section 39 of the Telecommunications Act 2001 (“the Act”), in the matter of an application for determination for designated multinetwork services under section 31 of the Act.

Clause 14.2.1 of the Network Terms requires that the increase in post dial delay introduced by the local number portability equivalent services offered by participating carriers be of not more than 1 second compared with similar calls to non-ported numbers in 99.99% of all call cases.

The Commission has granted Telecom an exemption from clause 14.2.1 of the Network Terms for the two call scenarios specified in Telecom’s application for exemption.

The period for which the exemption applies is between 1 April 2007 and 31 December 2012.

Notification of Determination for Telecommunications Service Obligations for TSO Instrument for Telecommunications Relay Services for the Period Between 1 July 2005 and 30 June 2006

On 7 March 2007, the Commerce Commission, pursuant to section 90(a) of the Telecommunications Act 2001 (“the Act”), prepared a final determination of the matters set out in section 92 of the Act for the TSO instrument for telecommunications relay services for the deaf, hearing impaired and speech impaired, for the period between 1 July 2005 and 30 June 2006.
