within an area/rohe moana described by a line
commencing at a point on the coastline at Hekerangi
Point (39°14.0′S and 177°50.8′E), then due west
for two nautical miles to a point (39°14.0′S and
177°48.6′W), then following a line two nautical
miles from the coastline around Mahia Peninsula
and Portland Island to a point (39°14.0′S and
177°57.0′E), then due west for two nautical miles to
a point on the coastline (39°14.0′S and 177°54.0′E),
then generally southerly and northerly along the
mean high-water springs mark to the point of
commencement.

Confirmation of tangata whenua—The whānau, hapū
and marae of Rongomaiwahine, as represented by the Mahia
Māori Committee, are confirmed as the tangata whenua of
the area/rohe moana to which the appointment of Kaitiaki
relates. -
Power to authorise the taking of fisheries resources
for mahinga mātaitai—The Kaitiaki may authorise any
individual to take fisheries resources managed under the
Fisheries Act 1996, other than those resources that are taken
in fresh water, for mahinga mātaitai purposes from within
the whole or any part of the area/rohe moana for which they
have been appointed as a Kaitiaki.

Fisheries (Kaimoana Customary Fishing) Notice
(No. 3) 2007 (No. 399)
Pursuant to Regulation 9 of the Fisheries (Kaimoana
Customary Fishing) Regulations 1998, the Programme
Manager (Deed of Settlement Implementation
Programme) at the Ministry of Fisheries (acting
pursuant to a delegated authority in accordance with
section 41 of the State Sector Act 1988) hereby gives
the following notice.
Notice
- Title and commencement—(1) This notice may be
cited as the Fisheries (Kaimoana Customary Fishing) Notice
(No. 3) 2007.
(2) This notice shall come into effect the day after the date
of its notification in the New Zealand Gazette.
- Interpretation—In this notice:
(a) "customary food-gathering" has the same meaning
as defined in Regulation 2 of the Fisheries
(Kaimoana Customary Fishing) Regulations 1998;
(b) "Tangata Kaitiaki/Tiaki" means the person or persons
appointed under Regulation 9 of the Fisheries
(Kaimoana Customary Fishing) Regulations 1998
for the management of customary food-gathering
within an area/rohe moana;
(c) "area/rohe moana" means an area described by a
line commencing at Whakapau Point (39°41.0′S and
177°03.7′E), then south-easterly for 200 nautical
miles to a point on the Exclusive Economic Zone
(40°39.9′S and 178°03.9′W), then south-westerly
following the Exclusive Economic Zone to a point
(40°50.8′S and 178°09.3′W), then north-westerly for
200 nautical miles to Te Rahui being a point on the
coastline at Huarau (39°52.0′S and 176°58.9′E), then
generally northerly following the mean high-water
springs mark to the point of commencement. The
geographical coordinates named are in terms of
the WGS84 datum.

Nomination of Tangata Kaitiaki/Tiaki—Ngāi Hapū
o Waimarama has nominated Hori Bartlett, Karanema
Bartlett, Walter Broadman and Lance Makowharemahihi
as the Tangata Kaitiaki/Tiaki for managing customary
food-gathering within the area/rohe moana. -
Appointment of Tangata Kaitiaki/Tiaki—On
21 February 2007, the Associate Minister of Fisheries
(acting pursuant to a delegated authority) confirmed, under
Regulation 9(1) of the Fisheries (Kaimoana Customary
Fishing) Regulations 1998, the appointment of Hori
Bartlett, Karanema Bartlett, Walter Broadman and Lance
Makowharemahihi as the Tangata Kaitiaki/Tiaki for
managing customary food-gathering within the area/rohe
moana. -
Confirmation of tangata whenua—Ngāi Hapū
o Waimarama is confirmed as the tangata whenua of
the area/rohe moana to which the appointment of Tangata
Kaitiaki/Tiaki relates. -
