Land to be Acquired for Water Supply, Recreation and Forestry Purposes—Wellington Region

Pursuant to section 20 of the Public Works Act 1981, and to a delegation from the Minister for Land Information, Ronald Alistair Jolly, Land Information New Zealand, declares that, an agreement to that effect having been entered into, the land described in the Schedule to this notice is hereby acquired for water supply, recreation and forestry purposes and shall vest in the Wellington Regional Council on the date of publication of this notice in the New Zealand Gazette.

Subject to section 59 of the Land Act 1948.

Subject to section 206 of the Land Act 1924.

Subject (as to the part herein formerly in Computer Freehold Register WN47C/376 that came from Computer Freehold Register WNC2/432, except Lot 4 DP 22895) to the restrictions, easements and reservations as set out in section 18 of the Reserves and Other Lands Disposal Act 1955.

Subject (as to part formerly in Computer Freehold Register WNC4/53) to a right to convey water and for that purpose to lay and construct pipes and ancillary rights over part created by Gazette Notice 727234.

Note that the subsoil of the land below a plane of 144 metres above sea level of the part marked "B" on SO 37001 (1453m²) being part of Section 787 Hutt District and hatched black on the diagram for the said Section 787 was acquired for railway purposes by Her Majesty The Queen under Gazette Notice B320233.1 and is thus excluded from this title.

Note that the subsoil of the land below a plane of 144 metres above sea level of that part marked "H" on SO 37101 (212m²) being part of Section 1 SO 30094 was acquired for railway purposes by Her Majesty The Queen under Gazette Notice B320233.1 and is excluded from this title.

Note that Section 2 SO 30094 herein (area 445m²) consists only of the surface and subsoil down to a plane of 6.10 metres below and approximately parallel with the surface of the land. The subsoil beneath Section 2 above was taken by proclamation 542028 for railway and is shown coloured sepia on SO 24516.

Gazette Notice 989186 declaring portion of State Highway 2 to be limited access road (affects the land formerly in Computer Freehold Register WN47C/376).

Appurtenant hereto are rights of way created by transfer 497154.3 (affects the land formerly in Computer Freehold Register WN47C/376).
