consent is given for Westhaven Shellfish Limited to hold quota shares for deepwater clam having a combined quota weight less than or equal to 80 percent of the combined total allowable commercial catches of deepwater clam.

Restriction on holding quota shares in other deepwater clam stock—The consent given in clause 3 is subject to the following conditions:

(a) Westhaven Shellfish Limited does not hold quota shares for any deepwater clam stock other than deepwater clam in quota management area 7 (PZL7); and

(b) Westhaven Shellfish Limited does not hold more than 80,000,000 quota shares for deepwater clam in quota management area 7 (PZL7).

Revocation—The Fisheries (Quota Aggregation Limit Exemption) Notice 2007 (No. F401) published in the New Zealand Gazette, 29 March 2007, No. 35, page 900, is revoked.
