Final Determination of Dumping Investigation: Certain Bound Stationery From Malaysia

Pursuant to section 13 of the Dumping and Countervailing Duties Act 1988 (“the Act”), I hereby give notice that I have made a final determination that, in relation to the importation or intended importation of the goods specified in the First Schedule to this notice (the “subject goods”):

(a) the subject goods are being dumped; and

(b) by reason thereof, material injury to the New Zealand industry has been and is being caused.

Notice is hereby given that, acting pursuant to subsections 14(1) and 14(4) of the Act, I have determined the amount of anti-dumping duty to be imposed on the subject goods to be the rates set out in the Second Schedule to this notice and detailed in the Third Schedule to this notice.

Description of Goods
Exercise books, note books, project books, sketch pads and pads of a type intended for the purpose of writing/printing/drawing, suited primarily for primary, post-primary schools and commercial sectors, having the following specifications:

  • HEIGHT: Not less than 75 millimetres (“mm”) and not more than 450mm
  • WIDTH: Not less than 75mm and not more than 450mm
  • LEAF: Not less than 20 and not more than 300
  • PAGES: Not less than 40 and not more than 600
    • Includes perforated or hole punched pages
    • Can be printed/unprinted
    • All colours
  • PAPER WEIGHT: Not less than 45 grams per square metre (“gsm”) and not more than 150gsm
  • LINES: Ruled or un-ruled; print any colour
  • COVER: Can be hard or soft covered
    • Pads, sketch and other types, may/may not be covered
    • Can be printed/unprinted
  • BINDING: Stapled, sewn, glued or wire bound

The goods are currently classified under tariff items and statistical keys 4820.10.00 11H, 4820.10.00 21E, 4820.10.00 29L, 4820.20.00 00F and 4820.90.01 00H of the Tariff of New Zealand, which classification is provided for convenience and Customs purposes only, the written description being dispositive.

Second Schedule

Amount of Anti-dumping Duty
The amount of anti-dumping duty to be paid on demand, in respect of each importation of certain bound stationery imported or intended to be imported into New Zealand from Malaysia, shall be the ad valorem percentage rates specified in the Third Schedule to this notice which shall be applied to the value for duty of the goods.

1 Other exporters for whom separate rates of duty have not been established may lodge a request, backed by the necessary supporting evidence, that separate rates of duty be established.
