Notice of Entry into Possession Of and Receipt of Income From a Mortgaged Property

Section 104DD of the Property Law Act 1952

Take notice that on 17 September 2007, FM Custodians Limited, as mortgagee under and by virtue of mortgage 7179840.4, which is registered against Computer Freehold Registers NA67B/469 and NA67B/470, being the property situated at 326–340 Karangahape Road, Newton, Auckland (“the mortgaged property”), has entered into possession of the mortgaged property.

The mortgaged property is described as a two-storey retail building at the front and a three-storey warehouse structure at the rear with access to Galatos Street.

The building has an approximate gross floor area of 2016 square metres.

The address of the registered office of the mortgagee is:
Level 1, 50–64 Customhouse Quay, Wellington

and all communications relating to the mortgaged property and future rental payments are to be sent to:

Notice is given, pursuant to section 35 of the Trustee Act 1956, that all creditors and other persons having claims to which that section applies, in connection with the estate* listed below, are hereby required to send particulars of their claims to M. F. Khan, Solicitor, c/o Khan & Associates, PO Box 23492, Papatoetoe, Auckland, on or before 25 October 2007.

Creditors and other claimants are warned that after that date, the estate may be administered or distributed having regard only to the claims of which the trustee has had notice.

Claims due and owing at the date of death should be so certified.

The wording of the question proposed to be put to voters in an indicative referendum is:

“Should all citizens initiated referenda be binding on the New Zealand Government?”

This notice is made in accordance with section 31 of the Fair Trading Act 1986.

Notice

  1. Title—(1) This notice may be cited as the Unsafe Goods (Lead in Children’s Toys) Notice 2007.

(2) This notice has effect from 20 September 2007.

  1. Certain children’s toys declared to be unsafe goods—
    Children’s toys which contain lead in their accessible parts at a migration level greater than 90mg/kg of toy material are declared to be unsafe goods.
